“Two senior Republican senators criticized Supreme Court nominee Elena Kagan Thursday for memos she wrote as a young law clerk to Justice Thurgood Marshall, saying the papers suggest she lets politics dictate her legal decisions,” the AP says. “Sen. Jon Kyl of Arizona and Jeff Sessions of Alabama said the writings show that Kagan was highly opinionated and wanted to use the law to achieve specific policy results, rather than deciding legal questions on their merits.”

Clinton Presidential Library is set Friday to release more than 40,000 pages of notes, memos and other files, mostly from Kagan's stint as a White House counsel during the mid-1990s. It's the second installment in a 160,000-page cache of Clinton-era documents from Kagan's past. The Senate Judiciary Committee, which is to begin Kagan's confirmation hearings June 28, has requested all documents from her tenure in the Clinton White House. The panel also requested papers related to Kagan's failed nomination to a federal appeals court, which are expected to be included in Friday's release.”

I think Justice Thomas sent a note to these senators, the last thing he wants is a law clerk who worked for Thurgood Marshall on the high court. ,he knows that if Elena Kagan in conformed to the high court, knowing her history with Justice marshall Oha my god can you imagine there first session with her there, she will see what a goof GHWB put on the court to replace her mentor Thurgood Marshall.
