Jon Kyl of Arizona and Jeff Sessions of Alabama said the writings show that Kagan was highly opinionated and wanted to use the law to achieve specific policy results, rather than deciding legal questions on their merits.”
More from the AP: “The William J. Clinton Presidential Library is set Friday to release more than 40,000 pages of notes, memos and other files, mostly from Kagan's stint as a White House counsel during the mid-1990s. It's the second installment in a 160,000-page cache of Clinton-era documents from Kagan's past. The Senate Judiciary Committee, which is to begin Kagan's confirmation hearings June 28, has requested all documents from her tenure in the Clinton White House. The panel also requested papers related to Kagan's failed nomination to a federal appeals court, which are expected to be included in Friday's release.”

Save your breath, IR- IF Obama appointed Moses himself, the right would find fault with it. They decided from the tabulation of the last vote in 2008 that no matter WHAT he did, he would have to taken down or at least be made to look foolish and wrong.

Well of course they are going to criticize her, the bubba's and good ole boys just can't stand it if a woman can prove she knows best, so instead of actually finding out what she thinks now (I'm not too worried about what she thought or wrote in the past, we have all been young, made mistakes, and for sure changed our minds more than once on an issue) they prefer to tear her apart for something that happened a long time ago. Kind of strange when you think about it - the repugnants wanted no part of looking into georgie's drunken drug addicted past but sure like to look at everyone elses. And they still don't want to discuss or have it publically known about dick's direct ties to halliburton - can you say "who's your main cause of an oil spill catastrophy?"! halliburton, that's who!
I hope the American voter is sick and tired of this and is ready to say enough! Treat all candidates the same, one does not get a pass where another is raked over the coals. all since are equal in my Bible, there is no degree of sin or wrong doing. I think Justice Thomas sent a note to these senators, the last thing he wants is a law clerk who worked for Thurgood Marshall on the high court. ,he knows that if Elena Kagan in conformed to the high court, knowing her history with Justice marshall Oha my god can you imagine there first session with her there, she will see what a goof GHWB put on the court to replace her mentor Thurgood Marshall.
Thurgood Marshall won Brown verses Board of ED. desegregating public schools.
Justice Thomas gave us sexual harassment laws and wants to resend affirmative action as will as civil rights laws
with her there i can see him retire.

Isn't it funny that the same repugnant ones that whine about having to read 2,000 page bills are now so eager to read up to 160,000 pages of material in order to find something wrong with Kagan? You Betcha! It's Hypocritical!

Whenever that dim Sessions sits in judgment of intellects like Sotomayor or Kagan, or any of the justices, seems as if something is very wrong with the seniority system. How about a Senate rules/traditions overhaul? Didn't health care kind of put a little light on that briefly?

Why is it thats its ok for Republicans tos ay its ok for someone like Harriett Myrs, GWB private counsel no less, to be nominated who was extremely partisan, but Elena Kagan because she worked for Clinton and Thurgood Marshall, one of the greatest judges ever to be on the bench because he championed everyone's civil rights is too political. Their hypocrisy knows no bounds.
