DWI clemency/donations spur questions

Questions are being raised about then-Gov. Huckabee's 2004 decision to grant clemency to a repeat Driving While Intoxicated offender in Arkansas named Eugene Fields, despite the objections of a law enforcement official at the time. Documents obtained by NBC News reveal Fields' case was handled differently from any other DWI clemency or pardon granted by Huckabee, and some Republicans are now suggesting significant political contributions may have influenced the governor's decision.

In August 2001, Fields, of Van Buren, Ark., was convicted of his fourth DWI charge, a felony in the state of Arkansas, was sentenced to six years in prison and a $5,000 fine. Fields reported to prison in August of 2003.

But prison records obtained by NBC News show that six weeks into that six-year sentence, Fields' application for clemency, a commutation of his sentence the governor could issue to grant Fields an early release from prison, was unanimously supported by the parole board. Within months, Huckabee issued his intent to grant executive clemency to Fields, who was released from prison soon thereafter.

On Fields' application for a commutation of his sentence, four options are listed as possible reasons as to why the application was being made, including, "I wish to correct an injustice which may have occurred during trial," and, "I want to adjust what may be considered an excessive sentence." No boxes are checked on Fields' application; instead "N/A" is written across the top of the sheet, for "Not Applicable."

Rhonda Sharp, a spokeswoman for the Post Prison Transfer Board, was quoted at the time of Fields' release saying, "I've never seen anything like this before," and called the handling of the case "very unusual." This week, Sharp told NBC News that even though there is no set time period within which an inmate's clemency application must be considered, the process typically takes at least a few months to a year, before being sent to the governor's office. NBC News has no indication that Huckabee had any influence over the parole board's 2003 vote, which recommended Fields' sentence be commuted.

But the governor's ultimate decision to grant Fields an early release from prison was met with scrutiny from the media and others at the time. The Arkansas chapter of Mothers Against Drunk Driving in a letter to Huckabee noted Fields had a history of re-offending, and "a track record of non-rehabilitation and of ignoring second chances."

When questioned by reporters about his decision to commute Fields' sentence, Huckabee said his decision was based on the parole board's vote. Today, in a statement to NBC News, the Huckabee campaign said Fields "deserved time in jail and received it." The statement went on to point out that Fields completed alcohol rehabilitation treatment, and that his prison sentence was reduced with "strong support from the community," and "to make room in an overcrowded system for violent offenders."

Supplementing Fields' application for clemency were tax receipts for donations totaling $1,120 made to the Salvation Army, one letter of thanks from the Arkansas Children's Hospital Foundation for a $2,500 pledge, and two more for donations made to a scholarship foundation and a Baptist Church charity.

But questions about the handling of Fields' case surfaced again in 2006 when he was convicted on another DWI charge, just two years after his release from prison. According to the police report, Fields drove into oncoming traffic on an Arkansas road and into the path of a police officer's car before crossing back into the correct lane.

Teresa Belew, executive director of MADD Arkansas, says that proves Fields should never have been granted clemency in the first place.

"Early release of an offender who has such a history only exposes the public to the likelihood of reoffending," Belew said, "which, in fact, happened in this case."

At that time, Huckabee was quoted as saying he was disappointed in Fields' actions. Today, his campaign said that after his relapse, Fields "received the maximum penalties." According to court documents, Fields paid an $800 fine and was released.

Documents recently obtained by NBC News now suggest that Fields' clemency case was handled differently from others with similar felony DWI convictions.

An examination of clemency records available in the Arkansas Secretary of State's office, provided to NBC News by MADD Arkansas, shows that in Huckabee's decade in office, only seven clemencies or pardons were ever granted for DWI convictions. NBC News independently examined those records.

Fields' case was the only one in which any objection was made by law enforcement, and disregarded by the governor.

Prosecutor Marc McCune filed an official objection at the time, "strongly" objecting to Fields being granted clemency, as did the sheriff from Fields' county, who suggested in his objection that Fields "should do his minimum" sentence. Not one of the other seven DWI convictions listed an objection of any kind, noting in each case that judicial and law enforcement officials "have raised no objections to applicant's request."

Fields' case was also the only one of those seven in which significant time had not passed between the time of the conviction, and the granting of the clemency or pardon by Huckabee.

One offender was 47 years old at the time of his conviction and was granted clemency "specifically for the restoration of firearms rights," at the age of 62. Another, who was convicted at age 41, was not pardoned until he reached the age of 58, at which point "all rights, privileges and immunities he enjoyed prior to conviction" were restored to him.

Fields was 62 years old at the time of his conviction; he was 65 when Huckabee commuted his sentence. That executive clemency made him immediately eligible for parole.

Some Arkansas Republicans are also questioning whether Fields' clemency was tied to sizeable political contributions.

According to Federal Election Commission records, a month after Fields' appeal was denied, his wife made a $5,000 donation to the State Republican Party in June of 2003. A month later, she made an additional $5,000 donation, again to the Republican Party of Arkansas. The following month, Fields reported to prison and began his clemency application process. He was a free man in less than a year.

A former elected official in Arkansas with fundraising experience for the State Republican Party says the timing of Mrs. Fields' donations raises serious questions about their intended purpose. He spoke to NBC News on condition of anonymity and says he is not supporting any Republican presidential candidate at the moment.

"In the summer of 2003 there's no real political activity," said the former official. "It's always a tough time to raise money in those periods, and all of sudden $10,000 comes walking through the door when there's no campaign going on? There's no reason to give that kind of money then."

Prior to his wife's donations, Fields had made a $10,000 donation to the Republican Party of Arkansas in October of 2000 under "Fields Investment Company," the name of his business. Both Mrs. Fields' 2003 donations and Mr. Fields' 2000 donation placed them among the largest, individual donors to the Republican Party of Arkansas in those years, on par with donations from members of the Walton family, of the Wal-Mart department store chain. The only other donation made by either Fields to the State Republican Party was in the amount of $500 in August of 2004.

The Huckabee campaign today responded to questions on the matter, saying only, "There was no connection between the handling of any clemency application and any political donation."

A woman identifying herself as Eugene Fields' wife would not answer questions when called at home by NBC News and immediately hung up the phone. A voicemail left at that same number remained unanswered at the time of this publication.

I think there need to be tough federal laws on repeat drunk drivers.  They kill thousands of Americans every year in VIOLENT accidents, despite what Mike Huckabee says.  If someone is > 0.15 blood alcohol content while driving, they should have their license suspended automatically for a year, and anyone who does it twice should go to federal prison for a few years - mandatory.  

I agree the most violent criminals are the first  priority, but repeat drunk drivers are next in line because of the violent public safety hazard they represent and their chronic recitivism; how about instead instead of releasing murders, rapists, molesters, drunk drivers, and violent battery offenders, we give them stiffer sentences, NO early releases, and instead free all the pot smokers in jail?  I guess that would be too logical and beneficial to public safety.

Our priorities really defy common sense sometimes, and Huckabee's laxness on repeat drunk driving shows me he's not even reliable on the stuff conservatives are supposed to be good on.  As a matter of fact, I bet no Repubican nominated, regardless of who it is, will take on the issue of being tough on drunk drivers, and yet at the same time they'll probably echo Romney's line about how marijuana is a plague on the American people.  (Ron Paul excepted).
Yea this is the kind of a** we need in office. 1st time offenders should receive jail time. There is absolutely no excuse for driving drunk. Driving drunk once is 1 too many times. Until law enforcement officials wake up and get tough with 1st time offenders, people will continue to die from stupid drunks.
It is now dirt digging time I guess. We need a positive campaign in order to truly judge the candidates positions as they now stand. Mud slinging turns off the voters to the mud slinger in my opinion.
Who cares! It's the American way. Land of the Greed, baby! What's the difference between Huckabee and the current president or any other elected official. Hell I would run for office and be truthful about why I am running, and that is for the money. The difference between me and the current elected officials is I would be honest about my greed and self serving agenda. This is the Status Quo here in the states.
Whenever someone suggests there should be a "federal" law on something, I guess it's a knee-jerk reaction to assume they are quite misinformed as to the law.  There is a Constitution and there is a separation of powers in this country -- and if a state wants to make no penalty for DWI then that is that state's power under the 10 Amendment -- or is that just babble to you?
The media also needs to look into Huckabee's connection with the Arkansas Republican Party coffers.
agreed----my son was nearly killed by a drunk driver----still suffers from head trauma----shoulder replacement,collapsed lung  and broken ribs back and front.The driver was given 2 years probation a couple of fines and laughed during the trial.The judge cautioned her attorney but it did no good.She showed up pregnant at the trial(pity plea)a year later.Attorneys and insurance companies still fighting.Pot smokers go to prison----and pay fines.
Huckabee has all kinds of similar ugly cross-currents in his political past.  Here we have the the GOP's premier hypocritical candidate pandering to the right-wing evangelicals for the religion vote.  People of his ilk have no shame - I am completely reminded of what we're suffering with now in the Bushco regime, and this guy was an equally crappy governor.  As usual, the GOP fields candidates that appeal to the lowest common denominator among the electorate.  

Living in the South as I do, it's difficult to comprehend that an entire region of the country buys into a duplicitious moron like Huckabee - well, they voted for Bush twice, so a would-be Baptist minister has got to have the ear of God - right???  Go figure.

This is what happens when religious fundamentalists gain control through the covert deal-makings of the godless Machiavellis that arrange such things.

George - In otherwords, what I am saying is that if a federal law exists prohibiting marijuana, and Huckabee wants to propose a federal law banning smoking cigarettes in public, both make less common sense than tough federal laws on drunk driving; I was making a comparison in the context where federal laws on such matters both exist and are still being proposed, which is the situation as it stands.

My point is that if one is going to talk about public safety, drunk driving is way up there.  Banning cigarettes in public?  I say at the very least give smokers a bar every few miles where it's OK, set aside just for people who want to do that, because to do otherwise is just going too far; they're killing no one but themselves, which you can't say about drunk drivers.  Pot smokers should be at the bottom of the list of concerns from a public safety standpoint, given zero reported deaths in five thousand years.

I'm going to play devil's advocate on this one, but I say let the punishment fit the crime.  I think our legal system has had a field day with this circumstantial crime that has gone on long enough.

First things first, new studies show that using a cell phone, either to talk or text, impairs driving as much or more then the .08 intoxication limit most states have adopted to receive their federal funds.  Now I know virtually everyone that reads this article is guilty of that crime.  Just to say that some people who drink and drive kill people, therefor if you drink and drive you're going to receive a sentence such as 6 years because you COULD have killed someone is a farce.  This is an issue of self control and is based on bad science.

On the other side, there are millions of people driving and texting or having phone conversations that cause accidents and deaths who are walking away uncited.  And repeating.  And causing insurance premiums to go up.  So think about your wife getting into an accident while calling you to say she'll be late, or your daughter being rear ended while speaking with a friend to get directions...and then losing their license for a year.  Spending a month in jail.  Losing their job.  Now you can't make a mortgage payment, and you have legal bills upwards of $10K and you're taking "attention awareness" classes for driver safety.

Your awareness while operating a vehicle is hindered by distractions abounding...DVD's, Satellite Radio, cell phones, cigarette smoking, etc.  Alcohol directly relates to brain activity, yes.  But how each person's body metabolizes the substance and it's effect on motor skills is unique to thousands of different factors at any given time.  So we measure someone's blood/alcohol content to give us an estimate of how their brain is reacting to the substance?  By measuring their breath??? Come on, this is a modern day witch hunt.

And the sad thing is, by the time science will have proven this beyond a reasonable doubt; cars will navigate themselves.  So we won't have to worry about talking, or drinking, or getting lost.  What will be lost, however, is our tax money keeping someone who failed to signal in jail for 6 years because he had a couple of beers for happy hour.
Huckabee supports the Fair Tax plan, and will gain large support for his campaign the more he talks about it.
It's amazing none of the media hounds seems to be checking out the Salon.com artile - "The darkk side of huckabee"  It was a real eye opener for me. I guess he'll be getting the same "scrutiny as Dubya got. WAKE UP journalists - do your job.
The prisons in Arkansas weren't overcrowded. In fact, there were years in Huckabee's term when the inmate decreased. He repealed truth in sentencing laws and always fought legislation that would increase penalties. Now he is making excuses. He needs to be exposed as a criminal coddler - if you were one of the few people who had to go to prison - just make a tidy contribution and you will be out in no time.

That is a good suggestion!  Huckelberry Finn, had more scandals while in office than did Slick Willie, but the Republican Rag (Ark Democrat Gazette) did not provide much coverage about his behaviour while in office!!  Dig and you shall be blessed with knowledge about this corrupt man of God, sic!!

Huckabee is toast.
This is not mud slinging.  Huckabee has a history of making poor decisions.  I hope Iowa wakes up in time and makes the right choice.  Right now I would say anyone other than Huckabee.  
This article more or less raises questions on how far a person intends to go to try to sniff out conspiracy and NBC is on the trail.  Huckabee exercised his rights as governor in a case that was already supported "unanimously" by the parole board.  The opposition was several law enforcement officials and some other people that thought this action was suspicious.  They are entitled to their suspicions, even when there is no substance. Of course that's what suspicions are, hunches, gut feelings, the things that can't be proven.  Basically, the people who had no actual say or legal authority in the matter are being quoted that they don't necessarily agree with the governor's clemency.  There are so many things wrong with the scenario painted in this article it is hard to imagine.  But let us begin.

First, if the ramifications of this person's offence were so heinous, I wonder why there aren't more than just opinions levelled at the matter.  Drunk-driving is incredibly bad, and it is opportunities like this offense that the staff of riteousness should be raised to combat the disease.  However, instead this man was not burned at the stake and it was not until the after the governor's clemency that people disagreed with the act,  rather than make it exceptionally clear that there was an everpresent danger at the inception of his crimes, and not at the fifth one.  In a well orded society, a person would not be gradually dealt with as the same offense grows in number, but rather he would be treated seriously by the laws and enforcement at the very beginning, before the possibility of a trend occurs.  I would personally rather see law enforcement be tough on crime rather than, say, tough-enough.  Secondly, the parole board is slightly more responsible than the governor for being in the position to actually offer the opportunity for clemency.  An entire boardroom of people agreed "unanimously" to give this guy a free ride, and the rest of the judicial system in Arkansas feels it is better to allow this to happen than to act differently or in opposition to future occasions.  In this case the morality of the board must be in question along with the governor, as well as the judicial and jail system in its entirety.  This does not look like a case that should be singled out for one person's actions.  Yet, since the article would like to make Huckabee the scapegoat on behalf of the entire state of Arkansas, then I guess we must question him in that regard.  I like where this is going, because the only reason this article was written was not to question the governor's actions against a drunk driver or a judicial system but by a suspected connection with possible lascivious fundraising activites.  Thirdly, the governor, or government in general, did not control anyone's actions.  Huckabee did not force this guy's wife to donate to the Republican party, and even in the article it shows that they have donated before, so they already have precedence in the matter, anways.  There was no contract, there was no paper trail, there were no smoking-gun conversations between them.  The evidence is with Huckabee rather than against him.

Everyone in this country has free will and exercises it as they choose.  In order to type, I must write of my own accord.  To go to work, I must walk or drive.  I do not have to do anything if I do not want to.  Mr. Fields did not have to drink and drive, he did. That's bad, but due to the desires of the American people, as illustrated by this case, apparently the state of Arkansas won't be enforcing stronger legislation on the matter of drunk driving antyiem soon.  Mrs. Fields did not have to donate, she did.  If you are a Democrat, you might think that is a bad thing, but at this point in our nation's history, people still have the right to give money to whomever they choose and not be criticized unduly for it.  Governor Huckabee had the right to grant clemency and he did.  The people of Arkansas could build more jails, they don't.  Maybe witht the improved school system Huckabee created for Arkansas, those kids won't grow up o become drunk drivers like this Mr. Fields.

Huckabee has lied on his resume yet again.  He said that he held a degree in Theology, he does not.  He then said he held a degree in Religion, he does not.  Come to find out his degree is in Communications.  Are you kidding me, how does someone like this rise up in the polls.  I guess it shows you how easy we Americans are to fooled.  Wake up America the Huckabee you think you know is a fraud.

Since I do not have all the inside facts to make a fair decision at that time, I would not judge. You are judging upon the opinion of others. Nobody should be doing second hand judgings. Try to make a better country for everyone.
I agree with HMT-MI, too bad some investigative journalism was not conducted on the draft dodging, drug using George Bush.  It is never to late to start.

The previous 10,000 dollars Mr. Fields contributed also coincided with his THIRD DWI conviction - but because he was spared jail time, the Governor did not have to intervene.

Upon his next arrest and right after sentencing, they give another 10,000 dollars and sure enough the Governor steps in to release him. It is truly sickening. He couldn't even list one reason why he deserved to be commuted. That section, he left blank and Huckabee went ahead without any justification and released him. Explain that one

This man is an absolute joke.  This just again shows that the South will vote for an idiot.  Huckabee... Bush... Clinton.  It is time for someone from the Northeast or West Coast.  This man lacks the charisma of Clinton and the scare tactics of Bush.  If nominated, he will only carry Southern states.  He will not get a Northeast or West state.  I highly doubt his ability to even carry Utah, which always votes conservative.  The Republicans stand no chance if they foolishly nominate this dirty preacher.  So, Southerners, listen up:  I know you feel all powerful after you mandated Bush into a second term.  But, we will reject Huckabee if you nominate him.  My advice, vote for someone who actually stands a chance-Guiliani (has good charisma, nice record in NYC, excellent leadership experience) or Romney (excellent business person, good morals, very intelligent, good record in Massachusetts).  What does Huckabee have to offer?  What did he do in Arkansas?  Guiliani lowered the crime rate drastically in NYC.  He cleaned the largest city in the country up.  I've been to Manhattan many times.  I feel very safe there.  Guiliani made it that way.  What did Romney do?  He actually acheived universal health care coverage in the Commonwealth of Massachusetts.  That is a huge accomplishment.  What did Huckabee do?  Well... this article I guess talks about the kind of things he did.  Guiliani and Romney were trained to be in leadership/political positions.  Romney even went to Harvard.  Huckabee, as he loves to brag about, got his degree in theism.  Which, I guess tranied him to be a preacher.  Well, maybe then that's what he should do.  In short, Southerners: stop alienating the rest of the country.  Keep your redneck.  We want a leader.  Guiliani or Romney or Democrat--Got it???
This guy is the real Deal!  He is going to make a great President.   Give him a chance.  He was the Governor and had the ability to grant clemency.   I raised my eye browse when I heard of the individuals that President Clinton grant clemency.   There is usually information that these men of government have at their disposal they "we the people" don't know about.

What Romney doesn't seem to be able to buy is positions on issues that would appeal to the public and yet not totally contradict everything he's done as Gov of TAX-a-chusetts.

He was with Bush on immigration, calling opponents of illegal immigration "racists". Now he claims he'll shut down illegal immigration. Nice flip-flop. I have worked in law enforcement now for over ten years.  I take personal offense to any politician who releases so easily those I work so hard, and risk my life in some cases, to incarcerate.  I think Mike Huckabee is probably a good man in his heart, but his apparent soft spot for criminals doesn't sit well with me as a voter.
If people insist on splitting hairs on clemency. Perhaps The good people of Arkansas can agree on Hillary and her husbands extraction of antiques and other historical pieces from the white house, at the time of their vacantcy.To condemn Huckabee for his decision to forgive is a common first response. Though the first response exampled by Mr. Huckabee was to forgive and forget.Considering his standards and beliefs.This was, and still is the right thing to do.Mr.Fields failed on his second, third and fourth chance. But haven't we all? Yes, he made some poor decisions. And yes he was caught, and punished according to the laws established on that date. Turning the other cheek seems to be a conditional issue. More so, when it serves those inclined to be better than others. Mr.Huckabee did what he believed was right, just like many of you would have done.To scrutinize his political ethics and possible lack of good leadership should be done with the kindness and wisdom not too often found in the world.If any of you have never committed sin or even made a dreadful mistake or decision.Then, let that person cast the first stone.In any state, but more recently in California, they will chase a offender or breaker of the law for miles.Through towns, city streets and alleys.Always, wanting to gain and maintain control of the situation without violence.Though at times the chances of stopping these people will have to be by force.This could spill over into the civilians with injury and or financial ruin always possible. So what do you do? Do you say he's a crook because of the $10,000 that the Fields donated to the Republican party? Remind yourselves that Mr. Fields had a unanimous decision from the board. The dollars given to the political party wasn't put in Huckabees hands or bank account. As you strongly are implying. The funds were given to the party. As to spend on the explaination for the betterment of understanding of the Republican wing's stand on the issues at hand. Are you thinking that the parole board were all Republicans? This is no different than Ms. Clinton recieving campain donations from a known crook a few months ago. Are we to condemn her for the recievership of funds from this man? When she wasn't proven to be privy to his illegal doings? Judge the man as the man he is. Take the beam from your own eye before you accaust him for only doing what his convictions told him to do. When do any of us have the right to look down our noses at what he did or didn't do? If at any time we would have that right, it would be after we have walked in his shoes and faced the same questions. Do you condemn the police for chasing a car thief through heavy traffic? When the odds say, this perpatrator will kill himself and have a better than 50/50 chance of killing others with him. So to save these civilians and innocent people from the potential of harm from this bad guy. What should the police do? Shoot out his tires? Run him off the road? Risk their own life to save yours? Oops! Theres that beam issue again.
If Republicans send Huckabee to the general, then we really are the dumb party.

No surprises here regarding Mike Huckabee. The "holier than thou" the candidate, usually the "dirtier than a wharf rat" the person. On the other hand, the Hilary Clinton's camp has got to be ecstatic with the possibility of running against someone with "a woman needs to heel to her husband like a dog" philosophy.

Please explain how Mr. Gore is a moron. Explain what you mean by a "weird royalty". Explain the series of events that would lead us all to be speaking Arabic. Explain why you feel you'd had enough of President Clinton. Explain why you believe President Bush to be a "strong leader". Explain to us why you are thankful that America is under the the control of George Bush rather than Mr. Gore or Mr. Kerry. Explain why we should listen to you when you're just ranting like an idiot yourself instead of giving us concrete examples of why we are better off under our current leadership than another, more nuanced one. When you've done that perhaps we can have a discussion. Otherwise, perhaps you should let the grownups talk.
All moral arguments aside - Huckabee simply will not win a national contest against the Democrats (I'm a registered Republican).  He does not have the money or organization to compete at a national level.  I understand the people of Iowa and South Carolina wanting to push him forward, but they don't seem to realize the "big picture."  Iowans and S. Carolinans - please don't make the mistake of handing the election to the Democrats.
