Sharpton threatens lawsuit over FL, MI

Al Sharpton is in Florida and said he is prepared to sue if Florida and Michigan’s delegates are seated as is. He said there are people who didn’t vote because they knew their vote wouldn’t count and “there must be a formula to factor” them in.

“There were many people that did not vote, because the DNC said their vote did not count,” Sharpton said on MSNBC. “Whatever way this is resolved, they must be factored in.”

Sharpton instead called for a re-do of the voting in both states. “There must be a way that people can exercise their right to vote who did not vote.”

Called it “absurd” that Michigan where uncommitted was on the ballot, would get their delegates seated as is.

”If they try to seat as is,” Sharpton said, he and the National Action Network are prepared to file suit.

As we noted in First Read this morning, Sharpton is in Florida to meet with local National Action Network chapters in Orlando, Port St. Lucie and Miami where they will plan to sign up people who will say they didn’t vote because they were “told their vote wouldn’t count. And we’ll do it in Michigan too.”

I am tired of MSNBC reporting that Hillary won Texas.  Most of your shows say Obama did not win.  Keith Oberman reported this weekend in Texas (as I was in Houston, that Obama won the Texas Caucus this week and therefore OBAMA WON TEXAS.  When are you going to stop spinning the news for the Clinton Criminals and their unseemingly vindictive and do-anything to win ways to get votes.  

How is Clinton more electable - she was first lady and that was it.

And as far as a RE-DO - The US doens't get to "re-do" Bush's war in IRAQ, we do not get to "re-do" dropping bombs on other countries, we do not get to "re-do" the economic jam that we are in, and Clinton or McCain do not get to "re-do" the decision to give Bush the Ultimate power that he got to take us into war and absolutely ruin our economy and our standing in this world.  This is not hopscotch or jump rope - this is our country.  What is this telling our children - that it is okay to do something that we know is wrong because "oh yeah that's right son - you will get to "re-do" your decision".  Decisions made to allow a re-do and allow superdelegates to pick Clinton will result in a McCain election. There will not be an Obama VP so stop talking about it.  People are tired of Clinton and their shady dealings.  That's why Obama is getting the votes. Many will stay at home or vote for McCain in the general if Clinton wins this thing.  
It's time somebody speakup and stop Hillary from manipulating things her way. Some people didn't vote, candidates didn't campaign, DNC banned their delegates and a high percentage of voters were uncommitted. How can anyone in their right mind call it fair to accept Hillary's demands. She is basically trying to defranchise a section of the voters and also twisting the verdict of those who voted for her in the absence of a competing candidate. A re-do is the only option. Since when did we care about 10 to 15 million dollars to do a voting thing right? Hillary is clearly trying to steal the election one way or other.
From what I have seen, Hillary Clinton did not have a problem with the Michigan and Florida primaries being disallowed by the DNC until she saw that this is the only way she could sort of catch up with Obama. Obama did not even stay on the ballot in the Michigan primary, and relatives of mine in Florida said they neither heard nor saw anything of or about him there before the primary was voted. The wisest way to straighten this whole mess out is one of four options. One, let the DNC's decision stand, and not count the Michigan and Florida delegates. The leaders in Michigan and Florida knew the rules for their Democratic primaries. The DNC told them that they could not hold a Democratic primary before 2-2--8. Two, Have the primaries in both states completely redone at the states' expense. This would be the most fair way overall, because bothe Hillary and Obama could present their case to the Michigan and Florida voters; then have the primary. Three, split the delegates 50-50. This might be fair also, because Hillary and Obama are basically running neck and neck. Four, make the Michigan and Florida delegates all superdelegates just for this election, and let them decide on their own. Fifth, apportion the Michigan and Florida delegates according to the current nationwide total popular vote in all primaries that have already been held. Hillary won big in Michigan because Obama took his name off the Michigan ballot. She won big in Florida because Obama did not make much contact in any way with the people there, according to my relatives who live there. I personally think Hillary will not want to do any of these five, and instead try to get the Michigan and Florida primary results as they stand as of now. She knows this is the only hope she has of possibly catching up with or getting ahead of Obama.

With regards to Hillary campaigning here in FL.  Again you in Boston, and I am originally from that area, have it wrong again.

Hillary DID campaign here in FL on the Sunday prior to the primary at the Lucky Strike Lanes on South Beach.

She was in addition standing outside the lanes holding a sign that stated in part "We want a president that can keep a promise."

Please if you are going to report on campaigning here in FL get your facts straight.

I do not pretend to discuss campaign issues as pertains to MA as it has been a few years since I lived there.

However I do agree that Sharpton should stay out of it and the DNC should abide by the rules that were originally set down.

However I will say as an Independent I would have changed my affiliation and voted but that would have been an exercise in futility since our votes would not be counted.  We did have a very important Amendment that was on the ballot.  And yes I voted on that because it COUNTED.

Florida's not conducted an election in years that could be trusted.  The state parties are as ineffective as Katherine Harris is a sleazy crook.  For anyone to say the states democratic presidential primary votes should be counted as is is just stupid or biased towards the ruthless Hillary Monster.   If Florida pays up to do it again...fine.  Then I'll stand back with the rest of the country and see if Florida can run anything but a third world election.
The Carter Center should be asked to intervene and find a solution.  Partisans for one candidate or the other should not be fighting over this.  Please urge the DNC to invite the participation of the Carter Center for their expertise and fairness in election solutions.
You can't seat FL without a revote...you don't need Sharpton to see that. They have settled on a revote anyway...it just matters how will it be done.
The resolution: the votes will be split evenly from both states.

It saves money, it is more than fair. Delegates get seated. We move on.

Look.  This is very simple.  
- Obama has won more Primaries than Clinton.
- Obama has more pledged delegates from Primaries than Clinton (do the math and this is factual)
- Obama has more Caucus wins than Clinton
- Obama has more overall pledged delegates than Clinton
- Obama hs more overall delegates (including Supers) than Clinton
- Obama and Clinton have both won 7 swing states.  Of these 14 total swing states, Obama has more electoral college equivalent than Clinton
- By the rules of the part and rule of law, MI and FL were stripped of their delegates.  There should be some type of revote or fair system to seat them, but they should not be seated as is since it opens up rule violations in subsequent years and is unfair to the parties.  If a revote happens and Obama looses, so be it, but do any Clinton supporters really think that HRC wouldn't cry foul if Obama had won these states?  Be rational.  Some voters were disenfranchised and didn't vote because they knew the vote would not count.
- Obama has more votes than Clinton in the Primaries

- Obama has won more contests than Clinton

The process will go on and if Clinton takes a lead, other arguements can be made, but what part of 'behind in the contest' does Clinton not understand.  Their manipulation of the story and media is unreal.  We've seen the Bush administration spin stories in their favor to go to war and the like.  Is this what we can expect in a Clinton administration?

This should not be about race, because Al Sharpton stepped in. Hillary has been pushing for this all long, and if thats the case than she is playing a race card. So please people do not use race. Hillary wanted this and this is what she gets. And yes Fl & Mich broke the rules. Hillary was pushing for this. I never heard not once Obama mention we should count Fl & Mich, real leaders follow rules. All of you who are arguing that Al Sharpton should stay out of it are full of it. All the candidates have agreed not to campaign in Florida and Michigan. But, sleazy Hillary went ahead with full intention to be able to use it later on if she was falling behind in the campaign trail. Now, she's trailing behind HAE wants the votes to count.

I agree with anyone (yes, even Al Sharpton) on the point that is would be outright WRONG if Michigan delegates were seated as is.  No other candidates besides Hillary Clinton were on the ballot.  So, a re-do MUST occur there.  However, Florida is a different issue.  All candidates names were on the ballot, and not candidate campaigned there.  Therefore, the playing field was completely even, so it is plausible to seat the delegates as was voted on their primary date.

Now one might argue that many voters did not go to the polls in FL because they felt their vote would not count, but you cannot argue that there was a greater number of Obama voters that did not go to the polls over Clinton voters (or vice versa).  But, you could still argue that these same voters would have gone to the polls if they had known that their vote was actually going to count (the main basis now of the idea to have FL do a re-do too).

A mail ballot is an interesting idea, and I think it will help provide a little more legitimacy to this entire process.

I don't trust the mail-in system.  Who RECEIVES the ballets?  Who COUNTS the votes?  WHO determines that ALL votes are counted?  We already have reports of votes being destroyed in primaries.  People have been caught on tape running away with ballets that ended up at the police station.  This is scary!!   I wonder how things would be going if Clinton had won 28 states and was ahead in the popular vote!

Howard Dean (an Obama supporter) says this wouldn't be fair because it would be a disadvantage for Obama since Clinton had name recognition. Floridian's are not that politically inept as to not have known who Obama was. There had already been many televised Democratic debates and Obama had already won states prior to Florida's Primary. Florida's Primary must be awarded, as is, instead of costing millions to redo a Primary where both candidates were on the ballot and obeyed the rules. To appease DNC/Howard Dean's mind set, Michigan should revote as a caucus instead of a Primary because in caucuses, Clinton has the disadvantage as uncontestably proven by the Texas 2 step. Clinton's base of working middle class and seniors are limited by the two hour framework of a caucus. This solution would ensure all the voters' voices of both states be heard, wouldn't cost outrageous millions, and would be a fair balance for both candidates.If DNC/Dean still states this wouldn't be fair to Obama, then let's revote every prior caucus as a Primary to be fair to Clinton. The only other fair solution, would be to revote both states as Primaries--but no one wants to pick up the cost. I adore Hillary and Obama so I am really torn about my decision.  Florida and Michigan...what's right.  Both states screwed up and now we are all filled with conspracies and opinions but the truth is it can't be fixed and all we are doing is dividing our party and making the Republician's look tempting for those undecided. Sharpton or Jackson, hell, it could have Rush and this still would have both the same discussion.  World, looking out and always seing black and white is really getting old...move on.
No one has brought up the fact that the Democratic Party in Florida had to hold their primary early because the Republican controlled state legislation voted to move it up -
the Dems would not have been able to hold a separate primary , as it is paid for by the State of Florida-
So we have the Republcans to thank for this 'mess'and the DNC, who would not waive the rules knowing this

To Kdicello and all the others who wonder who will be running the Country if Obama is elected or who blame Obama becuase Sharpton has the nerve to exercise his constitutional rights.  I have never been a Sharpton fan but he happens to be right on this issue.  I doubt he asked Obama's permission to make any statements.  To suggest that becuase he spoke out that it in someways indicates that he will run the country  if Obama is elected is just plain stupid. Will Limbaugh run the country if McCain is elected President?  Hillary knew the rules and she broke them. If any revoting takes place, then the DNC should be the ones to pay for it.  THey are the ones who shut out the voters and only because the race is gridlocked is it even an issue. My state has too many other Important issues to spend money on, then this.
I am a republican who voited for Obama. Hilary and Bill and just an extention of the Bush's with a different set of special interest buds.  If Hilary wins this primary i will vote Republican - just like every other republican i know. So I the Dem's really want to win they should pick the canidate who will win against the Republicans in the long run. As for Michigan and Floridy - they broke the rules - Hilary and Obama both agreed in the beginning - so if the people in that state want to be counted, they must revote.

Al Sharpton has always been a loudmouth moron seeking the limelight.  For 20 years, he has been a public buffon.  From his 1987 leadership of the Tawana Brawley hoax (15-year old African American girl who was found in dumpster after being missing for four days wound up accusing six white men, including cops, of raping her), which vaulted him into public consciousness, to his less-than searing analysis in 2007 of Mike Nifong, Duke lacrosse players' prosecutor ("I know this DA is probably not one that is crazy. He would not have proceeded if he did not feel that he could convict."), Sharpton has shamelessly made a fool of himself.

In this instance, he shows his fundamental ignorance of how the law works.  To sue someone else, a party must be aggrieved.  That means, one has to show that, as a result of the actions of the defendant, he suffered harm of some type as a result of some action by the defendant or defendants.  Neither Al Sharpton nor National Action Network can show that either suffered harm because some voters in Michigan and Florida didn't vote because they thought their votes wouldn't count.

In the end, it's just dumbbell Al struggling to get noticed yet again.  When will idiots like Jesse Jackson and Al Sharpton stop foisting their alleged leadership on us?
Being in Michigan I want to say I am not paying for a do over.  Everyone knew the positions before moving the primary (MI that they were breaking the rules and the DNC that the delagates would be lost).  So why change anything.  Don't count the delegates and move on!

Al Sharpton needs to stay out of business he doesn't belong in.  I am a Democrat living in Florida and I took the intiative to go and vote on January 29th - even knowing that the vote could possibly not count.  Why did I vote?  Because I knew that something like this would happen.  I can't speak for Michigan, but if individuals in Florida decided not to go vote because there was the possibility that their votes wouldn't count, that was their CHOICE to make.  All candidates had their names on the ballot here and everyone had the opportunity to vote for the person they supported.  

You'd think that after 2 Presidential Elections, the DNC would have realized the importance of Florida's votes.  Instead, they chose to play chicken and look at where they are at now...scrambling to fix this fine mess they've gotten us into.  Great job, Mr. Dean!  

I digress...Al Sharpton needs to mind his own business and let State party leaders fight it out with the DNC.

As so many leaders have said; if that happens we can all look forward to another four or eight years of W the II in John McCain.

So stop always making everything a black and white issues and learn to accept that we are all different and each of us has a voice, once we cast our vote.

Seriously, the way that most people act in this world makes me proud that I don't have children yet and furthermore makes me doubt wanting to have any to come into this mess.
