The Clinton camp's rebuttal

Posted: Wednesday, March 19, 2008 10:32 AM by Mark Murray

From NBC's Mark Murray
Here's the Clinton campaign's memo arguing that Obama is holding up a re-vote in Michigan: "On February 8, 2008, Barack Obama stood in the aisle of his airplane and told reporters that he would be 'fine' with a new primary in Michigan if it could be done in a way that gave him and Senator Clinton time to make their respective cases and the DNC signed off.  Since then, such a plan has garnered broad support from top Michigan lawmakers and the DNC has given its blessing.

"So Barack Obama is on board, right? Guess again. It turns out that his comments about being fine with a re-vote if the above conditions were met were just words."

Below is the entire memo...

RE: Obama’s Re-Vote Pledge: Just Words

On February 8, 2008, Barack Obama stood in the aisle of his airplane and told reporters that he would be “fine” with a new primary in Michigan if it could be done in a way that gave him and Senator Clinton time to make their respective cases and the DNC signed off.  Since then, such a plan has garnered broad support from top Michigan lawmakers and the DNC has given its blessing.

So Barack Obama is on board, right? Guess again. It turns out that his comments about being fine with a re-vote if the above conditions were met were just words. As yesterday’s headline in the Detroit Free-Press made clear, Senator Obama is the lone standout: “Michigan do-over depends on Obama's backing, Senate leaders say.”

The Clinton campaign believes the right to vote is a bedrock principle of our country and that empowering the people of Michigan and Florida to make their voices heard must be a priority for any candidate running for the Democratic nomination. As such, we must either honor the original vote or hold a state-run primary that doesn’t leave the taxpayers footing the bill.

So why is the Obama campaign refusing to give the people of Michigan the chance to exercise their fundamental right to vote? Let’s take a quick look at what the Obama campaign is arguing and explore why those arguments are wrong:

False Excuse #1: Barack Obama Wasn’t on the Ballot. The Obama campaign argues that their candidate wasn’t on the January ballot because the Michigan primary wasn’t sanctioned by the DNC and they were trying to comply with the early state pledge.  Let’s remember that the point of the early state pledge was to protect the role of the four states that held early nominating contests.  Well the contests in those states were protected and the people in Iowa, South Carolina, New Hampshire and Nevada got a chance to vote.  Keep in mind that nearly twice as many people voted in Michigan and Florida than voted in the four early states combined.

Senator Clinton signed the pledge and kept it.  Senator Obama signed the pledge and kept it in Michigan.  But in so doing, Senator Obama decided to go further and made a voluntary decision to remove his name from the Michigan ballot.  That was his right but it was also his decision.  As a result, he denied Michigan the opportunity to vote for a slate of candidates.  There aren’t many second chances in life but Senator Obama has one now and should ask the people of Michigan for their vote.  Why is he refusing to do so?

False Excuse #2: Obama Voters Participated in GOP Primary.  The Obama camp will argue that their supporters voted in the GOP primary because Barack Obama wasn’t on the Democratic ballot.  They argue that the legislation’s effort to comply with the DNC rules is unfair since the bill would prohibit people who voted in the 2008 GOP primary in Michigan from voting a second time in the Democratic contest.   On its face, you might think the Obama campaign is making a sound case.  But two points render their argument inoperable:

First, the Obama campaign has repeatedly said that it would comply with DNC rules and DNC Rule 2.E prohibits cross-over voting.  The draft legislation does not permit anyone who voted in Michigan’s Republican primary in January to now vote in the Democratic primary. Senator Obama has said that this is a key reason why he cannot support the legislation but that provision must be in the bill in order to comply with the DNC rules.  So while Senator Obama’s campaign says he will follow the rules, he wants one of them to be ignored.

Second, the Obama campaign’s allies in Michigan organized an effort to get people in Michigan to vote for “uncommitted” in the Democratic primary, helping to bring the uncommitted share of vote to 40 percent.  So the Obama camp can’t reasonably argue supporters participated in the GOP primary and didn’t vote in the Democratic contest.

False Excuse #3: Clinton Supporters Have Said They’d Raise Money For a Primary and They Back Clinton. The Obama campaign will argue that Clinton supporters have said they’d help raise money to finance the primary and that’s not fair.  Last time we checked, the Obama campaign wasn’t hurting for donors.  More to the point, Democrats are blessed this cycle with an energized grassroots.  We believe that appealing to everyday people to finance this primary exemplifies what this election is about: giving a voice to the voiceless.

False Excuse #4: Michigan Law Requires First-time Absentee Voters Must Vote In Person Before They Can Vote Absentee – Just Like in Illinois.  The Obama camp will argue that they are at a disadvantage because a lot of their supporters are college students who vote absentee.  But Michigan law says that a person voting absentee must cast a vote in person before they are eligible to vote absentee which will result in the exclusion of many Obama supporters, of whom many are first time voters.  The Obama campaign should be familiar with that sort of system since it’s the rule in Illinois and we didn’t hear too much complaining in the run-up to February 5 primary there.  More to the point, this rule will be in place in Michigan for the general election.  So will the Obama campaign use this excuse to justify writing off Michigan in the general if Barack Obama is the nominee?  We hope not.

The bottom line is that Michigan has all the problems and promise that we talk about in this country.  Competing in Michigan sends a signal that Democrats care and understand the people there deserve the chance to make their voices heard and need someone in the White House who will hear their voices.

If Barack Obama doesn’t want to help make that happen, Hillary Clinton is ready to do so.  We call on the Obama campaign to let the people of Michigan vote.

Barack should just hang on and NOT give in to Hillary's request. Hillary has moved the goal posts long enough.

Last year, as soon as it was announced that MI and FL delegates would not be seated for moving up their primaries, immediately there was whispering about how Hillary would use this to her advantage against Obama and Edwards. I noticed that several political commentators on various networks hinted at this over a period of several months. Now her plan to game the system and steal uncontested delegates while using MI and FL voters as cover is falling apart and she wants Obama's help to make her plan work.

She’s been bashing Obama in those states for months, trying to get her emissaries to personally finance those primaries, and making it seem as if it’s all his fault.

Obama will be the nominee and, once his nomination is finalized, he can deal with MI voters directly. Enough of Hillary.

Stand your ground Obama. NO RE-VOTE.
"Senator Clinton signed the pledge and kept it."

What part of it did she keep?  The part where she is claiming that she should get Michigan's delegates?
C'mon people, this is all smoke and mirrors by the Clinton campaign.  They don't want a re-vote in Michigan and they know that the Michigan legislature will not pass the bill even if Obama says he is for it.  You have to remember, by June, the Clinton tax records will supposedly be released (althoug I am sure they will have an excuse) and, if anything else, it will show the millions upon millions the Clintons earned while Michigan's economy went into the toilet.  It will hurt the campaign there.

Obama has a good chance of winning in Michigan and even with the revote- Clinton will not catch him.  She just wants to make sure he won't win in November so she can come in on some white horse in 2012 and be like "I told you so."
Seems to me Obama and his left wing cult members have torn our party and this nation apart. Way to go Mr. L Ron Obama. Hes our next GOD!!!!!
Obama's memo comes across as more credible - he is not attacking Clinton - He is laying out the very practical legal reasons why this is not a viable solution.

He has said he would support a re-do if it were fair. The Obama team hasn't simply thrown some reasoning out of left field - their memo makes a lot of sense.

Hillary's proposal will disenfranchise a large number of voters. That is a fact. And no amount of mud slinging and attempts to distract on her part can change that.

Michigan KNEW, when they set their primary, that their deligates would not be seated. The Candidates KNEW this - Hillary KNEW this. It is truly unfortunate, but it is the reality.

In stark contrast to Obama's memo - Clinton's is an attack that assumes facts it does NOT prove. It also relies on DNC party rules....while at the same time it is it has repeatedly promoted contravening DNC rules...the memo is wrought with contradictions.

Hillary's memo is an attack piece, Obama's is a well-reasoned, well-thought-out and persuasive argument.

Obama's just appears, on its face, more credible.
Obama is just like Bush... we dont know what to belief of him.  He is just playing the game of smart and using the AA's emotion to get his momentum, but it is sad that AA doesnt seems to care about  it, just to geta black elected is a plus for them, even when the candidate is surrorund by some very questioning people, with ideas and position very untiamerica...
I just cant trust that guy
OBama doesnt want a re-vote in florida or michisgan becasue he knows what would happen, it is not fair to have those two states out.  it will make the difference... EVERY VOTE SHOULD COUNT
Obama will say or do anything to win.  If Michigan looked like it'd favor him, he'd be fighting for a revote too.  He's manipulative and cunning, despite his supposed "clean politics" approach.
Didn't Clinton pledge not to campaign in Michigan?  What is she doing today? Campaining in Michigan
If this memo had been dated prior to the first vote, it would be legit. As it is coming now, due to political needs and not a true desire at a valid result it is worth very little.

Add to that the fact that Sen. Clinton obviously knew the status of the sanctions, and the fact the one of her Ministers of Propaganda voted to initiate those sanctions, and you have a memo that is worth less than very little.
Why should the Democrats be punished in Florida? It was the republican state house and gov. that moved up the primary not the democrats in Florida. Since everyone was on the Ballot in Florida let the results stand and have a revote in Michigan.
My logic might be off, but wasn't Ickes one the DNC that voted to sanction Michigan and Florida? He is on Hillary's campaign staff and was one of Bill's major advisors. So Ickes has been a Clinton puppet for over 16 years. It looks like the Clintons think this is a banana republic.
So - Obama wanted revotes UNTIL he figured out it may help Hillary.

Obama = nothing new, just another politician.
J. Merle Stanley,
You should apply for a job with the Clinton campaign.  Anything, absolutely anything it takes to enable  your girl to steal the nomination, isn't that right? Damn the torpedoes, full speed ahead and who cares if the Democratic party goes down the tubes? As long as Hillary gets to be the nominee, by hook or by CROOK.
Obama is tearing the Dem Party into pieces!!!!

But accusing the Clintons of racism is the ONLY way he could deceive voters into voting for him.
Now - Obama voters are having buyers remorse.

Obama and Wright are wrong for America!
Obama/Wright08

She'll grab the nomination even with a state that breaks the rules.  Rules are onl for the little people, I gues...
Doesn't sound like the Clinton camp is really dealing with any of the issues raised by Obama's concerns. It strikes me as a completely tone deaf response.
The issue of Fla. and Mich. is two fold. One is that a re-vote in both states coupled with recent news about pastor will probably give Clinton a nomination. Without re-votes Obama will sneak across 2024 delegate line since he will need much smaller percentage of Super Delegate total with closer finish line and with his lead in states won, total vote, and pledged delegates.
The second and I believe more important issue is voters iregardless of who they support not being heard. This is un-american irregardless of the "rules".
The states should be making a decision without imput from either candidate or their supporters. These states should worry about their own citizens only. Let the results be as it may.
The candidates are grown ups and they can deal with the results, but get both of them out of the discussions-NOW.

Wow, Obama supporters, do you guys really think Florida and Michigan don't matter? Look at the big picture. If his campaign continue to argue that case, he sure would lose in Nov. should he get the nomination.

At least argue for a revote, let the people from those states know their votes matter. And that they are not getting punished for the mistake thier Republican legislature committed.
While much of Ms. Clinton's logic is lacking, I really, really don't understand her first claim.

She broke a rule and calls that a choice and condemns Senator Obama for it?

How exactly can this be explained to me in a way that makes sense?
Well, first of all, I'm not liking the language "the Obama camp will argue".  Isn't that putting words in their mouth -- Lisa, New Britain, CT

Lisa it is the classic "straw man" argument used by sleezy politicians for hundreds of years and recently by Rush Limbaugh and his ilk. They could have just asked for Obama's explanation but that might have made too much sense so they invent ridiculous arguments which they put in his mouth so they can knock them down.  It shows huge contempt for the public.  I have been very disappointed by their campaign for a long time and am now convinced they have crossed the threshold of being party traitors.
Did the Clinton campaign miss the part about Obama and Clinton being allowed to make their respective cases? Is that not what Obama is doing?
Absolutely pitiful and desparate stuff from the Clintons and their campaign.  When she signed the pledge about Michigan and Florida, she pledged not to "participate" in any early primary those states had.  That should have meant taking her name off the Michigan ballot like all of the other candidates.

I guess it all comes down to her and Bill's interpretation of what the meaning of "participate" is.
As a Michigan Democrat I am glad Clinton is talking about taking action so that our votes can be counted.  Sure, I wish she hadn't waited until it was politically convenient, but better late than never.

A lot of people are talking about strict enforcement of the rules and sticking it to the people of Michigan to teach them a lesson about following DNC rules.  That's all well and good, but I suspect many of these same people will regret their position when the Democratic nominee has a hard time getting support or funds in Michigan and Florida.  The primary election may be a private affair run according to party rules, but the election in November is run according to the law and the US constitution.  The national leadership would be wise to remember that they can't prevent Michigan and Florida from voting in that election, and that's the one that really counts.

You can learn more about Michigan's primary debacle at http://WhoStoleMiVote.org/
Perhaps if it was a caucus, Obama camp will agree!

What is he afraid off? What he should be worried about is Nov. If he gets nominated, these two states will turn RED.

Losing Ohio, California, NY, NJ and possibly PA, DNC really should think things through. As in electibility big picture scenario.

HRC continues to bore the hell out of me with her rampant desire to do absolutely anything to win.  If they re-do MI, that will set a bad precedent and then FLA is going to wonder if they made the correct call (They did).  I have lost a ton of respect for Bill too now that he has adopted the same attitude.  He will also do or say anything to get back in the game.  What crap!  The polarization that everyone feared is happening in a big, devastating way.  The comments that I read on this site are very disconcerting and after the dust settles, there will not be enough time to regroup the Dems to defeat that moron McCain.

Let's get together soon.
Hillary Clinton signed a pledge and kept it ? That is RICH. Didn't the pledge say that she would not participate in any way? Once again Hillary Clinton is acting like a Republican.  Hillary Clinton is nothing more than a carpetbagging hack. In 2012 I will do all that I can to see that she loses her re-election bid for the senate. She won't get the democratic nomination. If she manages to steal it she'll be toast against McCain.
Hey ALL YOU CLINTONISTAS LISTEN UP!
When faced with a choice between a Republican and a Republican Lite the voters will go for original Republican every time.
Obama should drop out now!!  Any candidate who doesn't want FL and MI revoted will lose in the general!
Simple Question - What is Obama afraid of? Remind anyone of the Bush fiasco in Florida? If you dont get the popular vote, you'll just block the recounts too?The peoples vote is what should count - not arbitrary rules that violate the constitution.
I don't usually blog here because of the obvious - the same old Obama people with the same old rants. I don't know why but I thought I might see something different from the msbnc moderators and the Obama hateful. But it's the same landfill it always was.
The DNC decided that Florida and Michigan votes WOULD NOT COUNT

Hillary agreed
Obama agreed
John Edwards agreed
Joe Biden agreed
Chris Dodd agreed
Dennis Kucinich agreed

Obama took his name off the ballot
John Edwards took his name off the ballot
Joe Biden took his name off the ballot
Chris Dodd took his name off the ballot
Dennis Kucinich took his name off the ballot

Ony Hillary kept her name on the ballot
But, (see above) she said the results WOULDN'T COUNT

Byb, Bye Billary

Obama '08

She doesn't even address all of his points.  She cherry-picks the ones she likes and then doesn't even do a good job at responding to those.

What about the overseas votes?  No response.  What about the local clerks saying that a revote isn't possible.  No response.

Clinton has had so many views on the Michigan vote, it is hard to keep them all straight.
If there is no revote, Clinton should simply run as an independent that way all her supporters will put her in office despite the democratic party.
Here is the language from the pledge that all the candidates signed:

THEREFORE, I _______________, Democratic Candidate for President, pledge I shall not campaign or participate in any state which schedules a presidential election primary or caucus before Feb. 5, 2008, except for the states of Iowa, Nevada, New Hampshire and South Carolina, as “campaigning” is defined by rules and regulations of the DNC.****

Campaign or PARTICIPATE, that was the pledge.  By leaving her name on the ballot, Clinton did indeed participate in the Michigan primary.  She broke her pledge and now she wants a redo.  Tough.

Obama is a liar. BO is a fake. BO is a racist. BO is arrogant. BO has more skeleton's. Why doesn't our party demand this man drop out of the race before he does more harm to our country? The tenison between black and white friends is growing every day. Is this what he had in mind to bring us together?
Look at the new polls people.  I know you are not blind and deaf.  Obama's judgement to be part of this cult is very scary.  I am a 37 year old white man and Obama was not speaking to me yesterday.  He lied about being in the church(see interviews on Friday), His wife is a liability.  Hillary is now up 56-30 in Penn.  She is leading 40 points in the white vote 63-23, and is only down 63-27 from the black vote.  All americans have serious questions about what Obama truley believes.  His actions are speaking louder than his words and his words are not catching up.
Jay,
You're right.  EVERY vote should count.  And it should count equally.  Giving Michigan a primary in June makes their votes count more than everyone else's because of momentum.  I took my time to go to the polls and my state representatives followed the rules.  My vote should not be minimized by letting Michigan cheat.
HRC...........
The biggest loser of all time.
I can`t beleive the people that are working with her. They are just as bas as she.
They lack the judgement to just say NO to her or to tell her hey wait a minute don`t you remember you signed the damn paper too, GEEZ.

Her memory is fading fast and I wouldn1t want that for the country, I think that she is so delusional that she and Bill both need to have themselves checked into a mental health facility.

GO OBAMA '08!!!

How stupid can the Obama supporters be, don't re-run or come up with a way for the Michigan delegates to seated with full voting rights, will doom him in the fall, if he is so lucky to be the nominee. It still make me think that most of these stupid and Clinton hating comments are from closet Republicans. Neither Clinton or Obama created this mess, it was the DNC and they need to get it settled now!
"...False Excuse #3:

I wish they would use that money to help people that are in housing crisis, or those that need healthcare. The whole thing is at the end of the day, that is just wasted money. She will not win by a huge margin, and even if she does it is not enough to make the argument that she should be the nominee. This is really ridiculous. Bow out gracefully, Senator Clinton!! ..."
Dante (Sent Wednesday, March 19, 2008 11:04 AM)

That's just an excuse to disenfrachise 2 million voters in 2 different states that Obama knows he can't win.

I am ashamed of this country.  As I sit here and read some of the comments posted on this blog, I am saddened at the future of this country.  Both candidates agreed to the rules & to know hold one candidate responsible is unfair.  When you look and review the memos presented, one seems rooted in fact & the other rooted in slander.  American people please make & informed decision based on the facts presented.
I think I would like to vote for Obama cause allhis supporters here are so civil and make one want to be associated with them so with Obama too. My he is so lucky to have so many follow his words and he helps by telling them what they think and can do for HIM. Wow think he will do that for me too?
Anyone ever think Obama made that anti-war speech in front of a radical crowd because Wright wanted that.
hillary clinton is evil.  she is pathetic, and obviously totally void of any integrity, humility or grace.  GO AWAY.
CLINTON CONTINUES HER ATTACK AGAINST THE DNC

How far will senator Hillary Clinton go with her attacks or "discent" against the DNC for a rule that was crafted by some of her top advisors and aggreed on by all the major presidential candidates ??

Why is she attacking her own political party by telling the public that the DNC wants to disfranchise voters in Michigan and Florida, and that the DNC's act is un-american ??

Jules, Tennessee.
Sen. Obama isn't afraid of a fair and equitable re-vote- he doesn't have to be because Clinton would have to win every other primary including MI and Florida by at least 64-70 some percent in order to catch up to him in the delegate count, right???  So, your reasoning doesn't make any sense whatsoever.
LISTEN UP, YOU WHINING BUNCH OF BRATS - the states defied the rules - they were well aware of the consequences if they broke the rules.  now, they pay the consequences.  it is unfortunate.  but it is appropriate and perfectly fair.  GROW UP.  and that includes you, hillary.  go away.
Obama may portray himself as a candidate who could unite the country and put an end to the political nonsense, but he's no different than the typical politician.  How could he unite the country when he's purposely standing in the way of a fair re-vote and shutting out the voices of voters in Michigan and Florida??  I guess he's the "uniter, not a divider" in the same sense as Bush.  There's nothing worse than a political hypocrite like Obama fooling people into voting for his BS slogans and pretty speeches.  He's a fraud and that's that bottom line.
Let's see...

1) Hillary wants the vote of the people to count.
2) Hillary wants the super delegates to over ride the votes of the people.

Sounds like typical Clinton double talk.
Hillery!  Maybe you should rethink this Michigan/Florida revote adgenda.  It is very likly in the case of a Michigan and/or Florida revote that Obama will clean your clock just like he has in most of the other states recently.  Personnaly, I hope there is a revote so that you both have the opotunity to spend another 10-15 Million each on advertising in these states to help the economy.  As far a I can tell, thats the only part of your economec plan that makes sense.  Oh yea.  Spending money on campaigning(good thing), Beating up on each other campaigning(good thing), winning GE in November(bad thing).  Keep up the good work.  You are doing your country a favor in the long run.
