Detainees can challenge, court finds 5-4

WASHINGTON, D.C. -- In its opinion today, granting rights to the detainees in Guantanamo Bay, the court admits it is doing something it has never before been done -- finding that non-US citizens, detained by the U.S. in foreign territory, have constitutional rights. But the court said, there's never been anything like Guantanamo in U.S. history.

VIDEO: Enemy or not, the Supreme Court has ruled that foreign terror suspects have the constitutional right to challenge their detentions. NBC's Pete Williams reports.

The court's five-member majority also says that for now, things at Guantanamo will go on as they are, that the current military commission systems there "remain intact."

But what this does mean is that all the detainees there have the right to get lawyers who can go into the federal courthouse here in Washington and argue that each of them is wrongly held. 

So today's ruling is not a get out of jail free card, nor does it change the situation on the ground in Guantanamo. But for the first time since these detainees were captured and transferred to Guantanamo, they will now have the legal -- constitutional -- right to get federal judges in the U.S. to review their cases. For that reason, today's ruling is a game-changer.

The Pentagon plans to issue a response later to today's Supreme Court decisions which say detainees held at Guantanamo Bay have the right to challenge their detentions in U.S. courts.

Pentagon officials had said such a ruling would be a serious setback to the military commission hearings, and would essentially freeze the trial process for Khalid Sheikh Mohammed and 4 other 9/11 defendents arraigned only last week in a mlitary commission hearing at GTMO.

In September of last year, a majority of senators voted to allow Guantanamo detainees to challenge their detention in court, similar to today's ruling by the U.S. Supreme Court. But because Senate rules required 60 votes for the measure to proceed -- proponents had 54 votes -- the amendment died.

Leading the charge to grant the detainees habeas corpus rights were Sens. Pat Leahy (D-VT) and and Arlen Specter (R-PA), the bipartisan leaders of the Judiciary Committee. Other republicans who joined the Democrats were Dick Lugar (R-IN), Gordon Smith (R-OR), Olympia Snowe (R-MA) and John Sununu (R-NH).

C'mon Pentagon. Give us a break. The highest Court in the land (reckon that's where the Supreme in Supreme Court comes from) issues a decision and you don't want to salute and march sharply. Guess the military has changed a lot since I served my 25 years.

Everyone in the military and administration took an oath to obey and protect the constitution!!!
I hope everyone remembers it's decisions like these that will be affected by whom you vote for president.  (Especially those of you who are angry Hillary didn't win!) If you vote for McCain out of spite, or simply don't vote, and McCain wins, you can't complain when a completely different Supreme Court makes decisions for your children and grandchildren for many, many years.
All these Congressmen and Senators that have voted in lock step with the Bush Administrations desires, need to get voted out this fall!

That would include John McCain.

If terrorists commit a crime, punish them to the fullest extent of the law.  However, keeping people locked up without a trial is not the American way.  When Barack is elected we will again have habeous corpus and individual freedoms will be restored. No, on this issue I am not a screaming liberal, but a conservative constitutionalist. Actually the liberaterians and Ron Paul have something to say on this issue. Let freedom ring for all who are living on American soil.
Going back to the foundation of what made America different than anywhere else on the planet. We still have a ways to go before our values are restored, but progress is progress.

These are the kinds of issues Obama has been fighting for!!  Restore the Constitution.  Bush, Cheney, and cronies have wiped their feet on it.  McCain plans to follow suit.
Rightly so. Anyone detained for any reason should have proper representation.

The idiots who think we should be able to detain anyone, even under the charge of terroism probably don't realize that the same can happen to them. Being an american does not exclude one from charges of terroism.

All is needed is to be suspected of terroristic acts and BAM!! off you go to gauntanamo.

I applaud this decision. America is supposed to set an example of democracy, no matter how difficult. EVERYONE should have a right to a speedy trial and to challenge government efforts to jail them. Especially since it's been proven that Bush is not above using false information for his own ends.
From a Supreme Court stacked with Bush appointees this is a startling decision.  The response form the Pentagon is the same old same old.

The best way to illustrate U.S, power is through its utilization of its constitution.  In this case we provide our suspected adversaries right to counsel and right to fair trial.  Kangaroo courts should never be allowed. We should never be afraid of our impartial justice system.  It is one of the strengths and pillars of our representative democracy.  I have full faith that by providing these safeguards will not harm national security or allow them to "be set free" if guilty.  If ,has been the case in some of the detainees , they are not guilty then we illustrate to our enemies we apply a fair a justice system.  To do other is to embrace our enemies values and not ours.  This enhances our prestige not weakens it.  The days of fear needs to end.  I would like to know Mr. McCain's stance?  
It is frightening beyond belief that anyone would argue that a defendant is not entitled to a lawyer or the right to hear and challenge the charges against him.  

If Shrub and Co. can do that to detainees, don't think for a minute that they can't try to do the same to you.

So, the SC punted it back to congress. What they are saying is that they can't rule on something where there are no laws. Also, by reading the responses so far, I see the Democrats completely missed the point again.

What's chilling is that Scalia, Roberts, Alito and Thomas were all willing to let the government hold  these prisoners without affording them a fair trial.  These judges are such strict originalists, but they somehow missed the part about the government not holding people without trial? Judges with no confidence in our justice system? And we want to elect another Republican to appoint more of these guys, why?
Note to Bush administration. Next time just kill the terrorists on the battlefield. Doing so will keep the ACLU out of the process.

What if a close relative of yours was wrongfully accused?  Would you think it was fair to let them languish for years with no recourse?
I firmly believe that the government has the responsibilty to protect it's citizens.

I agree with Gary that the military has changed a lot since I served. But the civilian "leadership" has changed a lot too. Neither Bush nor McCain are anything that closely represents someone like Ronald Reagan. He was a realist and a pragmatist which is why he could get things done.

The Bush administration and a McCain administration would be riddled with ideologs and the geniuses from the American Enterprise Institute, the people who brought us the Iraq War, and being greeted as liberators among other policy blunders.

Common sense should rule the day, today and everyday, sadly it doesn't.

And now it's time to do some serious housecleaning in the Dept of Justice.  I have a close blood relative who works as DOJ in their upper eschelons and has become increasingly more biased, irrational and even unstable in his views about human rights and terrorism. This person actually believes that torture is ok and provides reliable information.

It's even scarier that he believes that all information he sees (with his "top TOP secret clearance") is actually 100% accurate.  WMD anyone? Bush Lies anyone? Incompetence anyone?

I truly hope that Obama wins this race and appoints a clear thinking individual as Attny General who will go thru the DOJ rank and file to weed out these crazy whack jobs and restore our judicial system.
This is a clear message that the configuration of the Supreme Court after Bush leaves office is a HUGE question in this election cycle. This decision is surprising out of a Republican stacked court, but thankfully the Law has prevailed. One of the most important things that Obama can do is start to appoint "younger, more liberal" justices to replace Ginsburg and Stevens, and any others that retire during his (terms) in office.

If you would like abortion to become illegal again, and or see the rights of certain populations of US citizens taken away by bigotry veiled as "strict constructionism", then just go vote for Johnny McSame. We could soon be living in a military state after that.

--I think that is perhaps a bit of a hyperbole.  I don't think anyone is cheering for the terrorists to be found not-guilty, by contrast for our government to handle appropriately the terrorists we have captured and to protect our country's image.  By contrast, I hear that a bunch of Obama-ites, Democrats and U.S. citizens in general are cheering for the U.S. of A.  The question Mr. Logger, why aren't you?
Well the Liberals and Kennedy couldn't find a right to private property in the constitution either so that's really no surprise.
You people seem to be forgetting that these terrorists were not detained by a police officer in Anytown USA.  They were detained in foreign countries by the armed forces and as such they do not have constitutional rights.  They are also unlawful combatants which means that the Geneva Conventions DO NOT APPLY...look up the definition of a unlawful combatant and you will see they are not entitled to Geneva Conventions or constitutional rights.  They are allowed to be detained for the duration of the conflict they were captured in without a trial.  
Another blow to the Bush/Cheney fascist view of democracy.  It's been clear for years that they have no understanding of, nor regard for the rule of law, nor for the Constitution.  The Pentagon of course continues to act like some de facto military junta because of their blind allegiance to Bush and Cheney.  They're also obligated to abide by the law, not make it up as they go along.  Like Conservatives are so fond of saying, if you don't like this country and don't want to abide by the rules and the rule of law, move.  Conservatives think that concept only applies to others.  Time for some self-medication.
