Obama's non-Dukakis answer

On the death penalty today, Obama sidestepped a potential political land mine. Opponents could have had something recent and tangible to tag him anew as a hard-left liberal had he answered any differently than he did on the issue.

When asked about the Supreme Court ruling against the use of the death penalty in instances of child rape today at a news conference in Chicago, Obama answered, “I disagree with the decision. I have said repeatedly that I think that the death penalty should be applied in very narrow circumstances for most egregious of crimes. I think that the rape of a small child, six or eight years old is a heinous crime, and if a state makes a decision that under narrow, limited, well-defined circumstances, the death penalty is at least potentially applicable. That does not violate our constitution.”

He continued, “Had the Supreme Court said, ‘We want to constrain ability of states to do this to make sure that it's done in a careful and appropriate way,’ that would've been one thing, but it basically had a blanket prohibition and I disagree with that decision.”

Previously, The Washington Post reported that Obama is a reluctant death penalty supporter. 
 
His answer was a sharp contrast from 1988 Democratic nominee Dukakis’ answer to a debate question about his stance on the death penalty if the crime perpetrated had been the rape and murder of his own wife.

Dukakis answered, “No, I don't, and I think you know that I've, I've opposed the death penalty during all of my life. I don't see any evidence that it's a deterrent, and I think there are better and more effective ways to deal with violent crime.”
 
Many, including Dukakis, cite the statement as the beginning of the end of his campaign. Since then, the issue has been a minefield for Democratic White House aspirants.
 
In reality, Obama’s answer to the question had more in common with his Republican opponent than his party’s 1988 standard-bearer.

McCain’s Senate office sent out a similarly worded statement: “As a father, I believe there is no more sacred responsibility in American society than that of protecting the innocence of our children. I have spent over 25 years in Congress fighting for stronger criminal sentences for those who exploit and harm our children. Today’s Supreme Court ruling is an assault on law enforcement’s efforts to punish these heinous felons for the most despicable crime.  That there is a judge anywhere in America who does not believe that the rape of a child represents the most heinous of crimes, which is deserving of the most serious of punishments, is profoundly disturbing.”

If the Supreme Court does not define the boundaries for the use of capital punishment then states, individually, can arbitrarily define its use.  If we are to be the only civilized nation on earth to have capital punishment, let us at least have a uniform standard for its use.

I'm a lifetime Democrat - and a mother. I agree with Obama. I disagree with the Supreme Court's decision for the exact reasons Obama stated so well.
Being a father of two girls Obama will kick you know what if anyone harmed them. I have three girls myself and I agree 110% with Obama I think the court was wrong on this one.

Those FLDS memebers and some Catholic Priests better take notes.  They better leave the kids alone.
While I personally disagree with capital punishment, for a myriad of reasons, I do admire the way Obama delicately tippy-toed around this issue.  Save for the most fanatical death penalty opponents, a majority of the country probably find his answer palatable.

In my honest opinion, Obama vehemently opposes capital punishment, but is doing what he needs to in order to win this election.  As an Obama supporter, while this is slightly disappointing, I'd prefer him to take the aforementioned position rather than wholeheartedly praise the Supreme Court's decision and bae relegated to the annals of history, a la Dukakis.

The Washington Post like other news rags have consistently distorted Obama's positions on lots of issues including nuclear energy, which he supports if he can find a safe way to dispose of the waste.

I don't agree with the death penalty.  But I am probably not the majority, and I love this country because the majority rules.  If enough people evolve into a new way of thinking, then we can change the law, and there is nothing stopping me from rationally discussing my views and changing the hearts and minds of my fellow citizens if I can.  Obama is right to take this stand of "talk to the states" and disagree with a decision that makes up it's mind for a large group of diverse thinkers.  I know injustices happen, i.e. slavery and the pro-choice/pro-life issue, and discussions and even CIVIL disobedience (not bombing women's clinics!) needs to happen to bring those issues to the front of everyone's minds (I can get complacement with my DVR and Video Games!), but forcing views on others does not work very well, look at Iraq!

As a person who believes in the sanctity of life, however, I'm horrified by Obama's position. Horrified. I hate this part of the election cycle.

I AGREE!  Anyone who rapes a child should be put to death!  Anyone who does that is defective and should be killed immediately.
Because Obama > Dukakis, Gore, Kerry, Carter, Mondale, and all the other Democrats who lost for being too "soft".

This shows that there is much more to Obama than the "far-left candidate" stamp that the republicans want to brand him with.  He is as smart as they fear he is and this will only complicate their ability to sell the "smear and fear" to America...both sides would benefit politicaly if they avoided being the standard bearer of each party's extreme right or left positions...McCain should take a look and learn a lesson from this and if he doesn't he will not win the center/moderate/middle vote...

I straddle the fence myself on th death penalty, but when it comes to our children, that's totally different.
I disagree with the Supreme Court ruling and it should be up to the states to decide.  SO we house these creeps in facilities using tax payer dollars, they are eating 3 hot meals a day, and maybe getting a chance at redemption.  

All the while a child is robbed and scarred for the rest of their lives.  That's why there is so much street justice is because the laws are seeming to assist the law breakers than the innocent children and the law abiders.

To me, I've always thought the question was fundamentally flawed and unfair to Dukakis and shows the hypocrisy of our moral compass as Americans.  It's presented as though his principled stance to say no, even in the face of it being a personal affliction, was somehow a type of character flaw.  But I'd bet 10 to 1 that if he were President and Lord forbid such an event did happen to his wife or daughter, and he somehow made a justification that that person deserved death for doing such a hideous crime against the family of the President, he'd be looked at cross-eyed.
During the Primary, the basic underpinning of the questionw as to say, 'hey..there is nothing more personal than for it happen to spouse or children...and nothing should stop you from delivering vengance.  And yet I believe we would act takenaback if he were President and used every leverage as President to ensure the death of the person who performed this act against his family. So in the primary it was ok to not be passionate if it happened to the other guy, but as President it's not ok, for him to leverage the Presidency to get it done his situation, but not ok for him to take a passive if it just happened to the other guy and his family.  
We have such shifting standards it amazes me.
I had no idea this was even up for a Supreme Court ruling.  I don't particurally favor the death penalty, but I understand many people do and that it is certainly permitted by the Constitution, however if given the choice between executing a convicted kiddie rapist and a murder, I'd have to go with the rapist.  This of course does fixes nothing regarding inappropriate police or judicial activity, but Obama has shown more leadership in that area at least than any other recent candidate so that's a positive.  Pretty good answer, indeed.  Have we potentially nominated the best person for the freaking job?  Incredible.    
Sadly, Sen. Obama's answer to the question about the Supreme Court's decision striking down the death penalty for child rape is as vapid and as un-thoughtful as Sen. McCain's.  The Court held that the death penalty for rape, even the rape of a minor, is disproportionate.  Rape victims, as badly as they are injured, do not die.  Death as a punishment is surely disproportionate.  Only 5 states out of 50 had authorized the death penalty for rape.  Even in those states, virtually no one was actually sentenced by a jury for that crime.  To top it off, it is REALLY bad public policy.  Child witnesses are notoriously unreliable.  We've already exonerated 129 inmates from death rows across the country for crimes they did not commit.  The death penalty for rape of a minor would substantially increase wrongful convictions and death sentences.  Second, levels of reporting of child rapes are terribly low, primarily because perpetrators tend to be relatives or close family friends.  If death is an authorized punishment, reporting of these crimes will decrease, not increase.  Finally, if death is an authorized punishment for rape as well as murder, there is no additional deterrence for murder, and assailants may well choose to kill their victims rather than leave them alive, if death is a potential punishment whether they kill their victims or not, in an attempt to minimize the risk of apprehension.  I am quite disappointed that Sen. Obama pandered to emotion on this issue.  The Supreme Court decision was not only reasonable, it was absolutely correct in terms of orthodox, Eighth Amendment analysis.  
Obama's no Dukakis on the campaign trail, either.  Nor is he a Kerry.  He's a tough competitor and he throws a swift, wicked counter-punch, apparently to the dismay of some liberal supporters.
Although we don't have polls on the matter at this time, I suspect most of the US feels as Senators Obama and McCain do.

It is inevitable that in applying the law to the facts of various cases that Courts will from time to time produce results which the majority of Americans think is "wrong."  That is why the Supreme Court should not have the final say on matters of Constitutional interpretation.  The power to write and amend laws and to amend the Constitution lies with the legislature, and if they have the power to write and amend the law and the Constitution, surely they have the power to over-rule the Court and say "No, actually, that's not what was meant at all."

As a strong Obama supporter and a person who has always been against the death penalty, I had to think long and hard about this issue.  I finally came up with the answer that anyone that would rape a young child with the possibility of getting out to do it again, I understood Obama's position and still can whole-heartedly support him.  Obama 08!

I'm a liberal supporter and I'm not dismayed by his answer.  I hate people who would rape a child and if a state proves he did it,  then he gets what he has coming. Obama's not only smart as hell, he's tough as hell and going to be a great President.
Thank you, Marshall Dayan. You elicited my feelings exactly, and much more succinctly and eloquently than I could have. I am an ambivalent death penalty opponent, but meting out the punishment of death for any crime lesser than death seems unambiguously disproportionate to me.
Dukakis was not an alpha male. Bill Clinton was. Gore was not an alpha male.  Kerry was not an alpha male.  Obama is.

Some of you are amazing, you want to make political hay over the rape of a child.  The Supreme Court was wrong, Obama and McCain are right to denounce the ruling.  I simply do not understand those who wish to turn this into some type of political circus, this is a child we are talking about here.  I am a father and God help the person who tried that with my daughter, I would be on trial, not them.  Some of you need to get off this political kick you are on and see this for what it is.  A very tragic ruling that could very well open a Pandora's Box and put our children in even greater jeopardy.  This is truly a very sad day for America and her children.

He will say whatever he has to at the time - then SPIN it next week - What I mean is.......   after his speech writer prepares a politically correct response.
Morally, I believe that taking another person's life is only justified in cases of self defense. However, I define self defense broadly, and I believe that society has the right to use the death penaly in cases where it is reasonable to assume that the criminal in question will commit a violent offense again. (This would include some repeat violent offenders, prisoners who commit violent acts while incarcerated, etc.) People that I respect believe that many sexual predators who rape children cannot be cured or rehabilitated and will repeat the offense if at liberty to do so and that these felons must either be locked up with no chance of parole (my preference)or executed. In light of all this, I find Sen. Obama's position a reasonable one.
Obama may have today avoided a potential minefield with his answer to the Supreme Court ruling, however come Nov. the same mine is going to bounce up and hit him in the farces...he is such a joke.
Trust conservative cranks like MSNBC to label defense of human rights a "land mine". Obama is turning every day into something more like exactly what we have now. But our world is being gripped ever more tightly by ultra conservatism. The truly laisez-faire economies prior to the great Depression of 1923 have been replaced by autocratic borderless economies that simply shrink and grow the hobbled class of middle-rung demologs. Retreating from popular liberty into point-blank murder, aka the death penalty (18% of current recipients known to be innocent), is an expected retreat. Democracy, where are you? Perhaps the only hope for the national disguise of free will and just liberty is contained through violent warfare. Hurry off to war, Obama. It's time to prove that we restrict our liberty and justice less than ...someone, somwhere!
Between this and FISA, I'm starting to think Obama is more of a Liebermann than we realized.

I particularly don't buy the "cruel and unusual punishment" reasoning the court used.  Either the death penalty is cruel and unusual, or it isn't.  How can it be cruel and unusual for a repeat child rapist, but not be so for a murder, espionage and treason?

And, frankly, if you want the height of hypocrisy, how is it that the death penalty is OK for espionage against us while we actively hire and condone the same activity against others?

We had a knocked up jurisdiction here in BC. About a decade ago, Interpol advised me that 74% (I will spell it out, in case you don't do numbers well) ...seventy-four percent of the jurisdiction had crossed the line. What did we do? Arrest one judge who died in his cell of poor health last year. One judge. Is this a call to finally rid ourselves of all our politicized hot-heads, because there's a good chance they tend to be pedophiles? Isn't that how we neutered the Catholic priesthood? I pity you having young children, Obama. You are completely on another planet. May we suggest that it is too late to chnage your job description? Get real.
When a Harvard Law School (and educated) Instructor of Consitutional Law (Barack Obama)gives an appropriate thoughtful answer, you hayseed, back burner bigots still don't know how to comprehend an African American male who possesses the intellect and forsight to be the next leader of the free world.
The Republican party just lost another talking point on the issue of death penalty. Obama just rendered them useless. I realized Bill Bernett was mad on CNN today beacuse Obama took the issue of death penalty off the table.

Like i have said in the past, Obama is a  smarter politicians than McCain. He knows how to take a wedge issue off the table. For people calling him Dukakis, i don't think that characterization fit. Obama is looking more like Ronald Reagan every day.

I agree with Obama on this one. The state should not be sanctioning murder. However, the rape of a young child is such an heinous crime, it does justify the death penalty. Obama's position on the Supreme Court decision reflects his reasoned sensibility as well as his appreciation for the US Constitution - 2 things that have been sadly lacking in recent years in the Executive branch.
Obama's response was a message aimed directly at the gay marriage cultists: execute pedophiles. If they think that he will ever support same-sex marriage, they should think again.

Though I support Obama's bid for the Presidency, I disagree about using the Death Penalty, for any crime. Life in prison with no chance of parole is good enough.

However, I also wouldn't lose any sleep about the prospect of NABMLA's entire membership being tossed into a gas chamber, either
While I can see why an action that does not kill anyone, or is not intended to kill anyone, can be said to not merit a death penalty, the Court's majority opinion leaves a LOT to be desired, that's for sure! OsiSpeaks.com
