Down the ballot: Challenge to Prop. 8

CALIFORNIA: A challenge to California's Prop. 8 gay-marriage ban will be heard by the state Supreme Court early next year. Could gay marriage end up making its way to the Supreme Court?

GEORGIA: "Former President Bill Clinton on Wednesday appealed to Georgians to send Democrat Jim Martin to Washington arguing the state's hotly contested Senate runoff must provide a 'bridge not a firewall' to the progress promised by President-elect Barack Obama," the AP reports. "'The hopes of America are riding with Georgia,' Clinton told a rally at Clark Atlanta University, a historically black college. Democrats are within two seats of a 60-vote majority that would give Obama a stronger hand in Washington and Georgia is one of two unresolved Senate races. Martin is locked in a tight Dec. 2 runoff against Republican incumbent Saxby Chambliss. 'Martin is the bridge, Chambliss is the firewall,' Clinton said. 'Don't let Georgia put a firewall up in front of the bridge.'"

Hours before Clinton stumped for Martin, “Chambliss was praised and endorsed by the executive vice-president of the National Rifle Association. Wayne LaPierre said in Atlanta that Chambliss is needed back in the Senate to protect gun rights. ‘We’re going to have some real battles in Washington,’ LaPierre said, who added that Obama will ‘break his promise’ to protect gun rights.” 

ILLINOIS: Rep. Jan Schakowsky of Illinois says that she's "certainly on that list" of possible replacements for Barack Obama's vacated Senate seat. The Illinois lawmaker noted her recent "long conversation" about the post with state Gov. Rod Blagojevich, whom she said plans to name Obama's replacement during the last two weeks of the year. 

MINNESOTA: The Coleman-Franken recount began yesterday. “By day's end, with about 18 percent of the vote recounted, Coleman continued to lead Franken -- but by only 174 votes, notably narrower than the unofficial gap of 215 votes at which the recount had begun. Franken's gain owed much to a swing of 23 votes in the Democratic stronghold of St. Louis County -- the result of faintly marked ballots and older optical scanners that failed to read the marks. The figures represent a Star Tribune compilation of recount data reported to the secretary of state and gathered by the Star Tribune.”

“Campaign monitors from both sides had challenged a total of 269 votes statewide, with Coleman observers disputing 146 ballots while the Franken camp challenged 123. If that pace continues, challenged votes could wind up being a major factor in a race where the margin is down to hundreths of a percentage point. Challenged votes will be set aside until mid-December, when a five-member state Canvassing Board will review them individually.”

By the way, this is fantastic: Minnesota Public Radio is posting some of the ballots being challenged... Some incredible examples.

“A Minnesota judge has granted a request by Democratic Senate candidate Al Franken for the release of information on voters whose absentee ballots were rejected. Ramsey County Judge Dale Lindman directed the county to produce the data by the close of business Wednesday. It complied."

NEW YORK: Andrew Cuomo is the overwhelming choice of New Yorkers to replace Clinton in the Senate if she's tapped to be Secretary of State, according to a Marist poll. Cuomo, whose father was a popular governor of the state and is currently attorney general, was the pick of 43% of people in the poll. "Reps. Nydia Velazquez of Brooklyn and Nita Lowey of Westchester were backed by just 5 percent of voters each."

I'm hoping it gets there.  It's about time we end the Second-Class status of GLTB citizens in this country and put this issue to rest.  It amazes me that with all of our patriotic bluster, we're still the most BACKWARDS thinking nation when it comes to this issue.

Martin is lucky to have Bill Clinton come down, and help him win the election in Georgia. Who really needs to go to Georgia is Obama. Big time! "Shameless Chambliss" needs to be politically, put in his place quickly. As for Hillaly becoming Secretary of State. At this point she is the best choice, and her husband Bill is going to cooperate fully. In Minnesota, the GOP/RNC smell a possible victory for "Crook Coleman." The recount up there is going to take awhile however, the "Masters of Manipulation" got their way. That is fact!
I hope the CA Supreme Court kills that despicable Prop Hate and sends the disgusting evangelical christian lunatic fringe a message to stop trying to steal people's rights.  Time to start taxing churches if they start wasting money on these hateful propositions.  If the churches want to stick their noses into politics then they can pay taxes for that privilege.

Jan Schakowsky would make a great replacement for Barack in his Senate seat.  I hope the Gov gets it done quickly.

Let's hope that Franken and Martin prevail so we Dems have that magic 60 seat supermajority so Barack can get progress done.
Have no idea why the governor of IL is waiting the last two weeks of Dec to appoint a senator. Our biggest fear is he will appoint hisself, as, at this
time he would not be elected as dogcatcher.
The politics in IL are like so many states. Constant
fighting among the parties and nothing done for the
survival of our state.
So many politicians have lost all realization that
they were elected to resprsent us and our future.
Would like to see the slate wiped clean in IL.
I, too, hope that Prop Hate will be overturned by the courts.  It is shameful that the Mormon Church funded that.

Does anyone know if there are any attempts to get the IRS to take a look at the Mormon Church's tax exempt status?  They deserve to lose it after this stunt.

Actually, the California challenge would likely not wind up at the US Supreme Court because the basis for the right to marry was found in the California Constitution in the first instance, not the US Constitution (and that the homosexual community was a suspect class, a finding the Supreme Court has hinted at but not made directly).  As a result, both Prop. 8 and the  challenge to it are rooted in California procedural and Constitutional law, not any federal right.  Under the principles of federalism and comity, this amounts to an independent issue without a basis for US SC jurisdiction.

A federal challenge will likely only emerge if enough states legalize gay marriage to a point where it appears that there is some sort of trend towards recognizing it as a federal right (the basis Kennedy used to find we shouldn't execute the mentally challenged) or otherwise challenging things like the Defense of Marriage Act on privacy or full faith and credit clause grounds.  
THE CONSTUTION SAYS THE RIGHT OF A MINORITY OVERRIDES THE MAJORITY. IT HAS HAPPENED MANY TIMES THRU THE CENTURYS.

ATHEIST WON FROM THE COURT AND THEY ARE SURE IN THE MINORITY SO I SHOULD HAPPEN BUT UNDER THIS COURT IM NOT SURE.
I protest Prop H8 whenever I can. California will not give up on this. it truly scares me that civil rights can be taken away with a 4-5% margin voting yes. Truly frightnening
Early voting began today in my county of Georgia, and I've done my part to help Jim Martin.  The Republican Congressional delegation from Georgia is such an embarrassment.  I would love to see Mr. Martin pick off Saxby... what a great day that would be for the good people of Georgia, and the nation.
I'm sick of legislators drawing up and passing laws they know to be unconstitutional and then accusing judges of being activists and legislating from the bench when they strike them down.
Hey, Joe Glayton, the constitution does not say the rights of the minority have precedence over the majority.  It does have mechanisms whereby a minority of our population, however you define it, has the right to ask for protection from the majority is abusing their rights.  Christ, go back to school and finally pass civics.  Oh, lay off the caps.  It didn't mask your ignorance.
