Taking Obama birth challenge to Court

When the justices of the U.S. Supreme Court meet on Dec. 5th, in their regular private conference to decide which cases to hear, two lawsuits that have captivated a segment of the blogosphere will be up for discussion.

Both urge the court to consider claims that President-elect Obama is not qualified to be president, because he is not a natural-born American citizen.

Persistent concerns about the qualifications of both major party candidates rank among the oddest aspects of 2008's historic campaign.

Article II, Section 1 of the Constitution provides that "No person except a natural born citizen" is eligible to be president. John McCain's status was questioned because he was born in the Panama Canal Zone and various theories have been advanced to cast doubt on Obama's.

Lawsuits over the inclusion of their names on state general-election ballots popped up around the country and were quickly dispensed with by local courts. But two challengers have pursued their cases to the Supreme Court.

Pennsylvania lawyer Philip Berg claims that the circumstances of Obama's birth are vague and that he may have been born in Kenya. Obama's mother, Berg asserts, later flew to Hawaii to register the birth.

Leo Donofrio, a New Jersey lawyer, contends that election officials in his state failed to ensure that only legally qualified candidates were placed on the ballot. Obama may have been born in the United States, Donofrio argues, but "natural born" status depends on both parents being American citizens. Obama's father was Kenyan.

The justices are unlikely to take up these cases for a host of reasons, not the least of which is the invitation to overturn the results of an election in which more than 66 million Americans voted for Obama. An equally high hurdle is the issue of whether Berg or Donofrio have the legal right to sue claiming a violation of the Constitution.

In dismissing Berg's complaint, a federal judge in Pennsylvania found that he failed to meet the basic test required for sustaining a lawsuit, because he couldn't show how the inclusion of Obama's name on the ballot would cause him -- apart from others -- some particular harm. Berg's stake, the judge said, "is no greater and his status no more differentiated than that of millions of other voters."

Other courts presented with similar challenges have reached the same conclusion, ruling that there is no general legal right to sue over the Constitution's eligibility requirements. Federal courts typically reject claims of legal standing based simply on a litigant's status as a voter or taxpayer.

The Obama campaign had hoped to end the controversy last spring by releasing his actual Hawaii birth certificate. But that prompted further questions about its authenticity, which were compounded when state authorities in Hawaii said they could not vouch for it, because they were constrained by the privacy laws.

Then, on Oct. 31st, the director of Hawaii's Department of Health issued a statement, proclaiming that he had personally seen and verified that the state has "Sen. Obama's original birth certificate on record," which shows that he was born there.

They cannot seem to accept they were defeated because of their political actions. They will never face or take responsibility for the diasters they have created for our country.

This idiots should be ashamed of themselves for acting like this.  What would it accomplish if they won this case?

It would make a majority of the country furious, and Joe Biden would become the President anyways.
Will one of you reporters kindly ask one of the members of congress that you regularly talk to about the security clearance investigation they have to undergo? If federal investigators determined that Senator Obama was ineligible for the presidency, don't you think we would have heard about it by now?  I know stories like this are great filler on slow news days, but come on already - a few phone calls could put an end to this phoney story for good.  
Hey, let 'em challenge Obama's birth certificate or whatever they want. Everyone's got a right to know.
The guy is so secretive about his being that you sometimes wonder who he really is. We're waiting to see if he can walk on water.

I suspose that Philip Berge has nothing better to do than spend his money on such garbage. Who is the governor of California? Should he challenge the majority of the Africian American population? Please go back in history and see how many "American's" that have been elected into the office of The Presidency that weren't born American. We are all son's and daughters of slaves one way or another. Does that disqualify us as being naturalized American citizens? What is his birth right? were his ancestors RED BLOODED AMERICAN? How does he think that America  became America? He should study his history...perhaps he will find out that he is not who he thinks he is.

This nations forefathers weren't born in America and as a citizen I can challenge that!
Some folks have way too much time on their hands.
Must be weird to walk around holding strongly-held opinions that are totally unencumbered by facts and evidence.  The Supreme Court will throw this out, but no amount of court rulings will dissuade these people, because their beliefs are based on irrational feelings like fear and ignorance and racism, not on facts.  You can't win arguments with those people, no matter how many documents you provide.
These 2 idiots Berg and Donofrio are just that, what is wrong with them.  Barack would not be where he is today, if he was not a legal citizen, pretty simple.  
The hardcore right wingers are absolutely right to question Obama's legitimacy, for who knows better than them that without due diligence some cocaine addict with hidden felonies and an  alcohol dependency could be manipulated into being a puppet president at best and irrational at worse - packing his administration with thieves and partisan hacks stuffing the DoJ with 3rd-rate hacks from Bob Jones University, the DoI and EPA with extraction industry vampires accepting sex and drugs in exchange for very loose accounting regarding public royalties.

Thank God there are some patriots left in this country.
These people need to find a hobby.  Their time would be better spent working for a charity rather than a racially motivated frivolous lawsuit attacking Obama's presidential eligibility.
obama was born in hawaii. his birth certificate states that fact. the birth certificate has been verified. such things are verified with background checks by the fbi and certain vetting agencies that aren't mentioned.

this is a very frivilous lawsuit and a waste of american taxpayers money. this is a perfect example of hate, partisanship and racism in disguise. the win by any means necessary. the point these people are not thinking about is if obama had the presidency removed from him at this point then biden would be our next president. however, this lawsuit has no standing what so ever!  
Talk about a waste of money--but better they throw it away now than use it for the next four years to propagate more scurrilous allegations.
If these claims had any merit, the courts would have disqualified PE Obama months ago.  However, it's nice to know these people have nothing more pressing going on in their lives than this.  Anyway, Happy Thanksgiving to one and all.
