Franken staying out of court, for now

Senate candidate Al Franken will not appeal a decision by the Minnesota State Canvassing Board, which today rejected the Democrat's request that rejected  absentee ballots be included in the race's hotly contested recount.

The canvassing board's decision was perceived as a blow to Franken, who trailed Republican incumbent Norm Coleman by just 283 votes Wednesday with about 80% of the recount completed. Some of the absentee ballots appear to have been improperly rejected due to administrative errors, and the Franken team hoped that -- when inspected -- the reconsidered ballots would yield votes to close Coleman's razor-tight advantage.

In announcing its decision this morning, canvassing board members emphasized that the Franken camp's request was not rejected on legal grounds, but because it is unclear if the board has the jurisdiction to mandate that the ballots be reexamined.

Estimates by the Franken camp and the Minnesota Secretary of State indicate that the number of rejected absentee ballots is at least 6000, and could be as high as 12,000.  The Democrat's team says that failing to count the small fraction of those ballots that were mistakenly discarded amounts to disenfranchisement. 

Democratic Majority Leader Harry Reid echoed that concern, calling the canvassing board’s decision “cause for great concern” in a statement issued this afternoon.

The state canvassing board will meet again next week.  Many observers believe that the fate of the discarded ballots will eventually have to be determined through litigation.

Still, top Franken attorney Marc Elias said this afternoon that, although the campaign is "disappointed" with the board's ruling, the campaign won't be taking the issue to court at this time. Elias painted the board's hesitation as a sign that election officials want to use the proper channels to prevent legitimately cast votes from being unfairly thrown out.

"Whether it is at the county level, before the Canvass Board, before the courts, or before the United States Senate, we don't know yet," Elias said today. "But we remain confident these votes will be counted."

Florida redux indeed it is, as well as, as Ohio redux.  The Minnesota secretary is giving Minnesota a zero candidate.
Don't certify a zero winner certify a real hero.
Unless the real hero, Al Franken is certified and declared winner, Minnesota gains a downward spiral.

2008 was the year that the Democrats could run any idiot and win. Franken, along with Obama, are proof of that idea.
There need to be a revote - similar to what's going to happen in GA.

Norm and the GOP, I would have to assume - purposely had people discard ballots, and manipulated the voting system so that he could win.

What a shame - don't give up Al!!!!
Lets hope Hillary is able to accomplish something.

With all the illegals that the Democrats and ACORN signed up and allowed to vote, is disenfranchisement really something we continue to be concerned about?
You just look at Franken, and you just laugh.
The goal of the Democrats is to bring the process into question, and the legitimacy of any Republican winner to the same point. Democrats never lose, they always 'Have elections "stolen" from them.'. You'd think most liberals would know better then to believe these hoaxes, but I guess that's why there are lots of stories about UFOs on TV now in days.
Yes, the canvassing board needs to keep re-examining the votes until they see the right thing. Franken figures greasing their palms with a $20 bill every few minutes should help them see the correct votes on those ballots.
Franken needs to put up a challenge to this in the courts. He needs to make a political stand here. Big time!

Hang in there, Al. Since the US Senate is the judge of its members, the issue must be dealt with at that level. Let's hope the leadership has the guts to make sure the vote of every voter is properly counted.

franken by no means is an idiot. he is a harvard graduate that chose the field of comedy. he is more than likely a lot smarter than anyone who would call him an idiot. as for calling the PEOTUS an idiot. it would take an idiot to call him that since he graduated from columbia university with honors and harvard law school in the top of his class and head of the harvard law review.

Actually, Gov. Palin is the only reason our idiot got any votes at all. She's the reason I voted for him. Palin 2012!
This is a no win situation for either candidate. Too bad there is not an automatic re-vote when no candidate gets over 50%.  Third candidate former Senator Barkley received over 10% the vote. So irregardless of who ends up with the most votes the system is flawed and neither side is going to come out looking good. Our foot-in-her-mouth MN 6th District Congresswoman, Michelle Bachmann also received less than 50% vote with a signicant number of votes going to the independent candidate. Yet she tries to vindicate herself as the people have spoken.  If more than half the people didn't vote for you that should tell you something.
