Obama signs equal pay law

With the stroke of a pen, President Obama signed his first bill into law and fulfilled a campaign promise to help make it easier to sue for equal pay.

The bill is named for an Alabama woman who found out her employer, Goodyear, had been paying her less than her male counterparts for years, but she was prevented from suing because of a statute of limitations in effect at the time. The new law effectively extends the statute of limitations.

Obama spoke often of the equal pay issue during the campaign, as did then-rival Hillary Clinton. And the president made special note of the fact that this was the first piece of legislation he was signing into law.

"It is fitting that the very first bill that I sign -- the Lilly Ledbetter Fair Pay Restoration Act -- that it is upholding one of this nation's founding principles: that we are all created equal, and each deserve a chance to pursue our own version of happiness," he said.

Ledbetter joined Obama on stage with Vice President Biden, Secretary of State Clinton and a group of lawmakers that included Democrats like Speaker Nancy Pelosi, Rep. Steny Hoyer, Sen. Patrick Leahy, Rep. Rosa DeLauro, Sen. Harry Reid, and Sen. Barbara Mikulski (who said as the group assembled on stage before the event "This is what change looks like.") Republican Sens. Susan Collins and Olympia Snowe also attended.

"And it is fitting that we are joined this morning by the first woman Speaker of the House of Representatives, Nancy Pelosi," Obama continued, to applause. "It's appropriate that this is the first bill we do together. We could not have done it without her. Madam Speaker, thank you for your extraordinary work."

Calling equal pay not just a women's issue but a family issue, Obama said the bill he signed today was for the women across the country who are still earning just 78 cents for every dollar men earn. "It's about parents who find themselves with less money for tuition and child care; couples who wind up with less to retire on; households where one bread-winner is paid less than she deserves; that's the difference between affording the mortgage -- or not; between keeping the heat on, or paying the doctor bills -- or not," he said.

The president went on to tie this bill to the country's economic woes, which is Issue No.1 as he seeks to get a recovery package through Congress.

"In this economy, when so many folks are already working harder for less and struggling to get by, the last thing they can afford is losing part of each month's paycheck to simple and plain discrimination," he said. "So signing this bill today is to send a clear message: that making our economy work means making sure it works for everybody; that there are no second-class citizens in our workplaces; and that it's not just unfair and illegal, it's bad for business to pay somebody less because of their gender or their age or their race or their ethnicity, religion or disability; and that justice isn't about some abstract legal theory, or footnote in a casebook."

this is a good signing. bush should have supported this bill. women having equal pay rights is very important. it is a form of gender discrimination. equality in the work place is an issue that should have been addressed a long time ago. this isn't a dem or repub issue. it is a right and wrong issue.

Except if you work 120 hours week building a business, and start making a lot of money, and hire dozens of people, and you become rich, in which case the government will determine you are evil, and that you are the enemy, and your wealth needs to be redistributed, and that you should be taxed for your un-thoughtfulness at the 70% federal tax rate, then the government sues you because you pay someone $10 less a year then someone else doing the same job.
Obama was stunned by something coming to his desk from Congress. He thought he ruled by just signing Executive Orders.
As soon as Obama signed it, Pelosi screamed at him "I want a raise!!".
Another campaign promise completed.  President Obama made a lot of campaign promises and at this rate he will do what he said he would do.  He is working on the economy, starting a dialogue with the Muslim world, shifting from Iraq to Afganistan, and returning our legal system to fit the Constitution.  Create a more positive tone in Washington by working with the republicans.  All this less than two weeks. This is the change we are looking for.
The Lily Ledbetter case is a textbook example of how the terms "activist judge" and "making law from the bench" only apply to decisions with which conservatives disagree.  No one doubted the intent of the law under which Ledbetter sued.  No one doubted the letter of the law.  That didn't stop the conservative majority from pulling a new interpretation out of thin air in order to reduce the rights of workers.
Corporations are not evil, they employ people. The greedy fat cats at the top and in the boardrooms are evil. CAP personal assets in this country at 20 million dollars,anything above that redistribute. This would not include corporate assets just personal ones. Nobody needs more than 20 million dollars to live comfortably. Do people really need 20 million dollar houses or 15 million dolar yachts. What would this effect the top 5% maybe? That would be 95% people a little better off. We need a cieling on greed its killing our country.
Good move. This does not mean you have to pay people equal pay for equal work if you can show and have documented that one person's performance is lower than that of the other employee. It simply means you cannot discriminate against a person regarding equal pay for equal work given all job related issues are equal.

President Obama knows what it's like... as Gwen Ifel spoke of on the Rachel Maddow show the Onion newspaper had  the headlines. "Black Man Gets Worse Job"
President Obama was a community organizer. He worked and still fights for people at the grassworks levels too. Now he his working very hard at the top level and experiencing un-neccessay partisanship. Cantor, I believe is accusing President Obama and Press Sectary Gibbs of Making Political Threats.

President Obama is courageous for tackling a job that is most difficult to repair. But then again, that's what's so super about Obama.

He cares and tolerates No Drama.

I see NBC had George Soros on this morning from the World Economic meetings going on in Davos. Nice to hear from the man who really is running the United States.
Gee it seems like President Obama actually intends to keep his campaign promises. It is nice to know that we have actually made a difference by electing him and the other Dems this time out.

...Dems To Leadership: Cut GOP Loose

Rank-and-file Congressional Democrats had been willing to give Republicans the business tax cuts and other provisions they wanted in the stimulus. That is, up until every single one voted against the bill on the House floor Wednesday.

Now, in both the House and the Senate, angry members are lobbying Democratic leaders to yank those tax breaks back.

House Speaker Nancy Pelosi (D-Calif.) was asked Thursday by the Huffington Post why the business tax cuts, whose purpose was to garner Republican support, would be left in the bill if no Republicans supported it regardless.

"That's what my members ask me," said Pelosi. "It wasn't something that was suggested [by Democrats]. It was a heavy lift for our members, but they understood that it has a benefit and were willing to support it."

So far, she said, she has been resistant to removing the cuts from the package. "It's something that we can live with," she said. "I can't answer why they wouldn't vote for this even though their main net-operating-loss carry-back suggestion was part of the tax cuts."

Majority Whip James Clyburn (D-SC) said that Democratic leadership was still willing to work with the GOP. "I've heard that discussion," he said of the push by Democratic members to take back the business tax cuts and include provisions, such as funds for family planning, that were eliminated due to Republicans objections.

Clyburn said he was still standing behind President Obama's call for a bipartisan approach.

Democrats on the Senate side, who witnessed the Republican shut out in the House, have had similar feelings, said Majority Whip Dick Durbin (D-Ill.).

Asked if Democratic leadership would revoke the Republican provisions of the bill, Durbin said that "we haven't reached that point, although there are many Democrats who are saying, 'Let me tell you: We included things in this package to bring in Republicans. It didn't work in the House. They didn't get a single Republican vote.'"

For now, said Durbin, Democrats haven't yet pulled out Republican provisions or asked the GOP to leave the table.

"We haven't reached that point," he said. "In fact, Republican senators I've spoken to today said, 'Don't give up on us. We still want to work with you.'"...'

A big women's basketball game between No. 2 Oklahoma and No. 4 Baylor just gained added prestige.

Former President George W. Bush and wife Laura attended Wednesday's game. The two entered several minutes before the opening tip, flanking Lady Bears coach Kim Mulkey, and received a prolonged standing ovation from the fans at the Ferrell Center. The group was engulfed by photographers and camera crews at the Oklahoma bench.

Pres.Obama has an enormous approval rating. As an independent, my patience with the Republicans in Congress is running out. You are out of power for a reason. Continue down the path and a popular and smart President can turn the tables on you easily. When the President talks to the public, we will listen and you might find less of you in power in 2010.

White House To Host Labor Leaders Tommorow, Sign Labor-Friendly Exec Orders


The Obama administration has notified leading labor officials that it will host them at the White House tomorrow at an event where President Obama plans to sign an untold number of executive orders that are friendly to organized labor, several labor sources tell me.

The event, which hasn’t been announced yet, is being seen as a big deal by organized labor officials, because it will affirm Obama’s commitment to the unions at a critical moment, and it’s the first White House event solely dedicated to hosting labor leaders. Among those who will attend tomorrow: AFL-CIO chief John Sweeney and senior SEIU official and Change to Win chief Anna Berger, sources said.

Union officials have been looking for a labor-friendly gesture like this from the White House. Some are privately grumbling that the administration hasn’t signaled a firm enough commitment to the Employee Free Choice Act, labor’s top priority. Others say he hasn’t been aggressively pushing for the confirmation of Labor Secretary designate Hilda Solis, which is still held up in limbo by Republicans for various reasons.

Spokespeople for AFL and SEIU declined comment, and the White House didn’t immediately respond.

“Administration officials have informed us that executive orders involving labor issues will be signed tomorrow at the White House, with labor leaders invited to attend,” a senior official at a major union told me. It’s not known precisely which executive orders are set to be overturned, and top union officials are scrambling right now to try to figure out what precisely the White House has in mind.

Labor officials say they’re not sure whether Obama will be reversing Bush-era exec orders that are bad for unions, signing new ones sought by labor, or both. But they’re cheered nonetheless.

“It’s unclear what the outcome of the meeting will be,” another labor leader says, “but it’s a big deal that he’s opening up the lines of communication with the labor movement.”

It's a new day...let it DAWN.  I can hardly wait for the end of white male hegemony and oppression.
This will cause more teeth gnashing of that august group of failed CEO bailout recipients headed by the Home Depot founder who are busy using bailout funds to try and defeat the Employee Free Choice Act. Their panic and alarm at the game changing in favor of their workforce is very satisfying enjoyable to me.

First Read please learn the facts. Prior to May 29, 2007 the statute of limitations was as it is again under the bill signed today. The 180 days did not begin to run until the last time the employer discriminated (wrote the last unequal pay check) against the employee due to gender. The May 2007 decision was the worst example of judicial activism ever, and it really isn't hard to understand!

The 1963 equal pay act allows for a sucessful plaintiff to get back wages, the plaintiff is only allowed back wages up to 2 years prior to filing the claim. Which is 730 days prior to filing the claim. If Congress intended the statutute of limitations to run 180 days after the first discriminatory act, there would be no need to toll (put a stop, place a maximum number on) the amount of pre lawsuit back pay. However the intent of Congress in 1963, which is once again codified, this time as clear as day (although it was obvious to any one with an average IQ before), was to allow victims of gender pay discrimination 180 days after the last discriminatory act to file a lawsuit, or an administrative claim with the EEOC.

First Read take note of the name of the Act the Lilly Ledbetter Fair Pay Restoration Act, the restoration refers to the fact that the law restores the law as it was prior to May 29, 2007.

It's bad enough the media failed to report on Justices Alito, Roberts, Scalia, Thomas and Kennedy's judicial activism, and spot light the hypocrisy of these "strict constructionist"  re-writing the legislation, and writing out safe guards by reducing the statute of limitations contrary to the express terms of the statute back in 2007, but to state this law was necessary "because of a statute of limitations in effect at the time. The new law effectively extends the statute of limitations." is infuriating!

The statute of limitations when Ledbetter filed suit was the same as it is today, Ledbetter did not miss the statute of limitations in effect at the time. Good Year made a crazy claim regarding the statute of limitations that should have been thrown out of court (it was rejected by the district court judge, but not by activist on the 11th circuit and Supreme Court)The Supreme Court on May 29, 2007 rewrote the law (i.e. right wing judicial activism), and as a result threw out Ledbetters timely filed suit, and prevented valid suits against employers from May 29, 2007 until today where the employee didn't find out they were being discriminated against until more than 180 days past from the first discriminatory pay check.
This is something that could protect my daughters from problems when they enter the work field.  I don't want to have to worry about them getting less than a man would.  
It is about time America! This is certainly one sure sign of change that finally makes sense. No one tell "Darth" Rove that equality is a large part of what America needs to stand for. Time to move forward America!

Good for President Obama and the US.  This is long overdue.  Obama has proved thus far a President of action, hope he keeps it up.

OBAMA SAYS WE ARE ALL EQUAL --- EXCEPT THE REPUBLICANS.
It's a heartfelt feeling to finally have a President that realize's that people really are out there who have to struggle and have to choose to pay for groceries or pay for oil so you have heat when i read this it brought tears to my eyes because i was so happy someone is finally going to do something about this. People go to work everyday and work hard and just can't make ends meet because everything goes up except our pay checks.
