First thoughts: Tea time

*** Tea time: Who would have ever thought that a discussion of tea bags -- even used as a verb, from both the right and left -- would become a political topic, let alone a subject we’d mention in First Read. But here we are… On this Tax Day, some Americans are attending so-called "tea party" or "tea bag" events across the country to protest everything from tax rates and the federal bailouts, to the young Obama presidency. But let’s be clear about one thing: These tea parties are hardly non-partisan events. While there’s certainly a grassroots component here, these parties have been co-opted by a major America political party (the RNC's Web site allows for creating send-a-tea-bag post cards to Dem leaders) and an entire cable news channel (which has been promoting the events). The main Web site for the events today, Tax Day Tea Party, is funded by conservative groups, and a public records search shows it's registered to a conservative techie, Allen B. Fuller, who used to be a legislative correspondent for GOP Sen. Richard Shelby and who touts creating Web sites for Republican elected officials. Also reportedly involved in today’s protest events are FreedomWorks, a conservative group founded by former House Majority Leader Dick Armey, and Americans for Prosperity.

*** What Republicans might stand to gain -- and lose: With its association with these “tea party” protests, the Republican Party does stand to gain here in a mechanical/process way. If it gets a huge turnout nationwide, it will be a bit of a test run for its social networking apparatus. The Tax Day Tea Party Web site, in fact, is reminiscent of what the Obama campaign was able to do with things like voter registration and grassroots meet-ups. You can click on a state and find where there's a local tea party in any state in the country. This kind of tech savvy could pay dividends in the long run. On the other hand, this whole thing could backfire if some unsavory elements (i.e., people saying and doing some very stupid things) attend these events. Also, what happens if today’s parties don’t capture the imagination of anyone beyond the GOP amplifiers of FOX and talk radio? Today has turned into a big test of the power of the GOP grassroots in the Obama era. The pre-game for these tea parties has seemed a bit scattershot. One can sense a hesitance from the establishment wing of the GOP about getting too involved in this movement, for the fears we've described above. Tax Day has normally been an easy P.R. hit for the GOP, but with the tea party gamble, the GOP doesn't seemed focused on good 'ol fashioned tax issues.

*** Obama on Tax Day: As for what President Obama is doing on Tax Day, he will deliver remarks at 11:55 am ET about “restoring fairness to the tax code,” as well as “providing tax relief to working families” in the stimulus, the White House says. How big of a political issue have taxes become? Not much, according to a recent Gallup poll. It found that 48% of Americans think the federal income tax they pay is “about right” -- one of the highest scores on this question since Gallup began measuring it in the 1950s. The poll also found that 61% believe the federal taxes they’re paying are fair. In the last few years, the GOP has seen its advantage on the issue of taxes deteriorate, and it's something that has thrown the party for a loop -- as without taxes as a rallying cry, the GOP has found itself with fewer issues to brag to the public about.

*** Shad Planking: Some states have annual time-honored festivals that mix fun and food with politics. In Iowa, there’s the state fair. In Kentucky, there’s Fancy Farm. And in Virginia, you have Shad Planking, which takes place today in rural Wakefield, VA. That event -- named after shad fish cooked on wooden planks (trust us, it’s an acquired taste) -- essentially kicks this year’s gubernatorial contest in Virginia into high gear as we head into Sunday’s Democratic debate (moderated by NBC’s Andrea Mitchell), the June Democratic primary, and the November general election. Shad Planking starts at 2:00 pm ET, and gubernatorial candidates Bob McDonnell (R), Terry McAuliffe (D), and Brian Moran (D) begin speaking at 4:00 pm; a third Democratic candidate, Creigh Deeds, is skipping the event. At Shad Planking, the gubernatorial candidates will be able to test drive their campaign messages, as well as display their organizational muscle through the sign war, which the Moran folks are all but conceding to McAuliffe’s campaign.

*** The never-ending recount: In the latest news in the Coleman-Franken race, the Democratic National Committee says it’s airing a radio ad in the Twin Cities that calls on Coleman to concede. “Franken won the election in November, he won the recount, and now he has won a legal challenge filed by Norm Coleman,” an announcer says in the radio ad. “Yet Coleman, and national Republicans who want to thwart the will of the voters, have vowed to file more appeals and hopeless legal challenges that will only result in more delay.” A GOP strategist close to Coleman emails this response to First Read: “Democrats can beat all the pots and pans they want, it won’t change the fact that we’re appealing, we’re going to the Minnesota Supreme Court, and we’re going to raise serious questions about how the recount and contest were handled, period.”

*** NY-20 update: As of yesterday afternoon, Democrat Scott Murphy was leading Republican Jim Tedisco by 47 votes (77,982 vs. 77,935), with absentee ballots still yet to be counted in Washington County, which Murphy won, and big Saratoga County, which Tedisco won. New York Democrats have been telling us that Republicans have been challenging a large number of Democratic absentee ballots to mask the size of Murphy’s lead (the challenged ballots aren’t counted in totals). And now we learn that Republicans have challenged Sen. Kirsten Gillibrand’s (D) absentee ballot. While we don’t know if Gillibrand’s ballot is valid, Democrats have seized on this, and Gillibrand even wrote a Huffington Post piece about it. In this contest and in Minnesota, Republicans have made a BIG DEAL about counting every vote. If Gillibrand’s vote is valid, that undermines that argument a bit, no?

The Repukes will claim large crowds at these so called tea parties.  Question is why now, why not when the Repukes were running everything and driving us into the ditch?  Reason-- the only give a damn about themselves not this country- Repuke = Enemy of the state!

“In May of 1773 Parliament concocted a clever plan. They gave the struggling East India Company a monopoly on the importation of tea to America. Additionally, Parliament reduced the duty the colonies would have to pay for the imported tea. The Americans would now get their tea at a cheaper price than ever before. However, if the colonies paid the duty tax on the imported tea they would be acknowledging Parliament's right to tax them. Tea was a staple of colonial life - it was assumed that the colonists would rather pay the tax than deny themselves the pleasure of a cup of tea.

The colonists were not fooled by Parliament's ploy. When the East India Company sent shipments of tea to Philadelphia and New York the ships were not allowed to land. In Charleston the tea-laden ships were permitted to dock but their cargo was consigned to a warehouse where it remained for three years until it was sold by patriots in order to help finance the revolution.

In Boston, the arrival of three tea ships ignited a furious reaction. The crisis came to a head on December 16, 1773 when as many as 7,000 agitated locals milled about the wharf where the ships were docked. A mass meeting at the Old South Meeting House that morning resolved that the tea ships should leave the harbor without payment of any duty. A committee was selected to take this message to the Customs House to force release of the ships out of the harbor. The Collector of Customs refused to allow the ships to leave without payment of the duty. Stalemate. The committee reported back to the mass meeting and a howl erupted from the meeting hall. It was now early evening and a group of about 200 men disguised as Indians assembled on a near-by hill. Whopping war chants, the crowd marched two-by-two to the wharf, descended upon the three ships and dumped their offending cargos of tea into the harbor waters.

Most colonists applauded the action while the reaction in London was swift and vehement. In March 1774 Parliament passed the Intolerable Acts which among other measures closed the Port of Boston. The fuse that led directly to the explosion of American independence was lit.”
Am I the only person who found it ironic that Eliot Spitzer showed up on Morning Joe-ke this morning to pontificate about how HE would handle the financial crisis, when it was his mismanagement of his own finances that led to the discovery of his involvement with the prostitution ring?

Now don’t get me wrong, Mr. Spitzer has every right to share his opinion, regardless of his personal shortcomings, but I found his tone to be just a touch too preachy and arrogant with zero humility as he implied that his way was the ONLY right way, and the approach of Obama Adminstration was all wrong.

It was just a little too early in the morning for that much envy and sour grapes.

P.S. Watching everybody sit back and agree while Joe accused the federal government of investigating soldiers and equating a watch on extremist groups with spying on Republicans was also a puke inducing moment . . . but then I’m used to that.

Of course 48% of Americans think the amount of taxes they pay is "about right".  They don't pay any income tax at all.
The problem with Astroturf campaigns (as opposed to grassroots campaigns) is that there's always a paper-trail.  You can't manufacture populism just like you can't manufacture musical groups (when was the last time you heard a new LFO or 98 Degrees song?) to stand the test of time.  There may be a major turnout at the tea parties, but there's already a split between those who consider themselves "real teabaggers" from those who joined up with the GOP movement.  

It reminds me a lot of a scene that I'm heavily involved in: hip hop (and no, I'm not MC Michael Steele).  I breakdance, and have since the late 90s.  Once "You Got Served" came out, there was a whole new crop of people at battles who had no idea what they were doing and garnered no respect from anyone there.  They faded away about 6 months later.  Now, the same thing is happening because of MTV's America's Best Dance Crew.  They'll be gone soon, too, I'm sure.  This is to be the fate of the teabaggers.  They'll show up for one day, yell a lot, maybe raise some money, but after that they'll go back to their regular lives and grumble to themselves about the Obama Administration.  Meanwhile, Ron Paul supporters will continue to make noise about these issues just like they were BEFORE today.
My favorite Kool-Aid recipe: Take a 2 quart pitcher,  fill it three quarters full with water, add one package of Grape Kool-Aid, one cup of real sugar, stir well and put it into the fridge overnight. Resist the urge to drink it immediately. A twenty four hour aging process brings out the bouquet of the grape and the memories of childhood. Priceless! Plenty to go around regardless of your station or persuasion and everyone loves a little Kool-Aid (some more than others).

It doesn't matter if the Tea Parties are so called "successful" or not. Obama's spending plans bring only ruin to the American and world economy. The little speech of his yesterday said a lot about nothing. Obama was cheerleading, which is strange  because the very instituations he tore down only a few months ago, now he's advocating. Obama finally realized who controls the success/failure of his administration I guess, and it's not him.

Obama will fail with his economic plan. More unemployment. More under-employment. Double digit inflation, double digit interest rates. Dust off the Jimmy Carter "Pain Index" because we're going to need it real soon now.
Sloppy reproting on NY-20. Saratoga and Washington are just the counties that have reported zero absentees at last word. Most absentee ballots also remain to be counted in Columbia and Warren counties. You can read the current results on the BOE official website.
             Tea Time

I imagine all the "Moon" people who post on FR will be out today doing something with tea bags. They should be easy to spot on TV with their "I love sexy Sarah" tee shirts. Maybe some will get their picture taken with Glen Beck or Dick Arney.

What will this accomplish? At best...nothing.  At worst...chaos.  This non-event makes no sense at all.  Ninety percent of Americans are receiving the Obama tax cut thus increasing their take-home pay.

So what can we learn from today's event?

1) The conservatives are more and more out of touch with main street America.  The polls are showing this to be true.

2) The conservatives suffer from a poverty of ideas.  Compare our President's imformative speech with the cut taxes slogan. Whether you agree with the speech or not, it is a well thought-out plan.

3) This is not a grass roots event.

4) There is no republican leadership, the conservatives remain in control and will not give it up.

5) The homeland security concerns are legitimate.  Ther is a growth of right wing extremism comprised of several hate groups. It is a sad statement about who we are becoming.

MSiera:  yes, Reagan was right-but you are leaving out the entire context of his quote.  It is the percentage of the deficit that matters, not the actual number.  

During Reagan's administration, the deficit as a percentage of GNP (which was ehat we used then to measure the economy, rather than GDP), dropped to the 3% range.  This is akin to having your debt drop from 10% of you income to 3% of your income-you are in a better financial state.  This drop can be accomplished one of two ways-you pay down your debt, or you raise your income.  During the Reagan years, we increased federal receipts, (income) which simultaneously increasing output, decreased tax rates while simutaneously increasing tax receipts, and, yes, increased the whole dollar size of the federal deficit while simulteaneously decreasing the percentage of GNP.  

It isn't rocket science.

What Obama is doing is spending us into oblivion by increasing the deficit at a time of shrinking GDP.  Now, I admit, spending by the government is necessary during recession-but how that money is spent matters.  So yes, to road projects; no to increased bureaucracy which further deteriorates the economy both instantly and in the future.  And, no, health care for every american is NOT  a productive way to spend the people's money.  Neither is in home counseling for first time low income mothers.  Neither is increased government mandates on states that cannot afford the mandates that exist currently.  It's all in how the monies are allocated.  And, believe me, the allocations and proposals are not allocating the monies where they will do the most good, but the most damage.  If Obama has his way, we will permanently reduce output, permanently reduce GDP, and be paying tax rates to pay for these programs that will permanenetly reduce household income.  

I get that you are an Obama worshipper, but, for crying out loud, read a book, rather than the Dailykos or Huffington Post.  You might learn a few things that temper your hero worship.
I don't think the repubs will gain anything from their tea party.  If they want to help their party, they should keep John Mccain off the tonight show with Jay Leno, because he proved what a hypocrite he really is when he named his top repub pick to run for president in the next election.  Sarah Palin was nowhere on his list!  Yet he picked her for his VP just last year.  He chose her to be one hearthbeat away from being pres of the US, knowing she didn't know her a$$ from her elbow.. TALK ABOUT PUTTING YOUR COUNTRY FIRST;  he put himself first not his country;  He just did what the religious right wing told him to do, "that coward."
You don't really expect Republicans to stick to principles, do you? They'll say one thing in Minnesota and the exact opposite in New York if it might help them continue to shift the costs of government away from the rich and onto the rest of us. THAT'S the only consistency in the GOP's policies and tactics.
Obama should have his spokesperson come out today and respond to the tea parties, by saying something to the effect that these participants are protesting a straw man, because most if not all, will either get tax cuts, or not pay more taxes under the Obama plan.  They should spend less time throwing tea bags around, and more time coming up with viable alternatives.

NY-20: by raising a totally frivolous challenge to Gillibrand's absnetee ballot, Tedesco has made it clear that (1) should he lose the official count, he'll embark on a Coleman styled scorched earth legal challenge that could last all the way until this same seat is up for re-election, or (2) should Tesesco win, by a slim margin, he'll claim that any legal challenge by Murphy is a democrat attempt to steal the election.  

On an unrelated topic, NYrs should protest democratic state senator Ruben from the bronx, for his homophobic opposition to the marriage equality bill that is set to be introduced in the legislature.  Why should committed same sex couples be made to suffer because of the thin skinned sensativities of others who find same sex marriage icky?  Why should we protect some intangible thing, marriage [what it should be protected from still remains unclear], at the expense of basic protection for same sex couples? Why should same sex couples go without inheritence rights, the right to make medical decisions for each other, the right to visit each other in the hospital, just to placate the fears and intollerance of others who oppose same sex marriage?  Wills are challengable and are subject to costly probate proceedings...marriage brings autmatic inheritence without the cost and inconvenience of having to probate a will. Health proxies are only as good as the paper their written on, and if you don't have it on you at all times, you can't made decisions for your partner in an emergency. Under these circumstances, it is just plain mean and nasty to oppose marrige equality.  In fact, only reason people oppose it is because they hate or are uncomfortable with gays...that's not enough to bar a whole segment of our population from having the right to marry...from putting form to substance...we already live in committed relations as close to legal marrige as we can get...its now time to make it officially legal! Enough already!  Equal Marriage Rights by Any Means Necessary!
It's kind of fun re-visiting the Boston Tea Party. My office is right on the Harbor, located in one of the hotels, and I can either walk to or look out my office window and see exactly where the tea party took place. It's neat.
So, I wonder who the republicans expect to pick up all those teabags when they're finished with their little rallies, and who they expect to pay for the cleanup, not to mention pay for the police and security that will be necessary to protect them from rabid democrats armed with assault weapons.  The government, perhaps?  
Who cares if it is Republican or not??? There are 2016 events palnned across the country. I think the bottom line here is that it is a conservative movement that others are participating in. Our government is out of control with its spending and is leading us down the road to socialism. Its time to show Obama/Pellosi that we are not going to allow them to ruin this country.
What's different about the non-partisan tea parties than every day news coverage of liberal-leaning agendas?  The tea parties may have coverage from 1 news network today, but any leftist event or agenda has coverage from 2 networks, full time.
How's the government going to make us forget AIG and all the bailout cashouts to CEO's and bonuses..anybody going to answer that one?

Let's all hope that today's worthless tea bag party garbage fails to draw many.  But the way fox and freaks has been promoting and sponsoring these unpatriotic events they will draw out all the conservative crazies who want their 15 seconds of fame and have no other way to achieve it on their own merit.  These unpatriotic cheapskates even have the gall to fly American flags.  But it shows their true nature as they waste perfectly good food, pollute our rivers and streams and throw litter on the ground.

The Irrelevant Elephants have only one siren song of tax cut welfare for the rich and greedy showing they are the party of never share.  Their 28 years of tax cut welfare for the rich and greedy, Raygunz's Tinkle Down VooDoo economics have left us all wet from the wrong kind of golden shower that drove up the massive national debt by $9 trillion!  Heckuva Job Cheapskates!

I love that radio ad for Senator Al Franken!  When will sore loser coleman finally get a clue that he's lost and he needs to concede?  The longer he waits the worse it will be for his political future which looks rather bleak now.  Ha Ha the man who told us the truth about The Big Fat Idiot is going to the Senate soon!

The actual sponsorship of these events by corporate entities is what crosses the line. I don't remember any anti-war demonstrations,

Here in Boston, the conservative radio station WTTK is promoting the event and supplying logistics and personalities. It's being run just like a Howard Stern or Opie & Anthony radio promotion stunt.

This is all fine with me, just don't try and foist these planned and sponsored promotions as a grassroots movement. There may be a sucker born every minute but I'm not buying this snake oil.
If you think the conservative "Tea Party" movement is daunting, take a look at a new report issued by the Department of Homeland Security that says right-wing extremism is on the rise throughout the country.
In the report (a full copy of which is below), officials warn that right-wing extremists could use the bad state of the U.S. economy and the election of the country's first black president to recruit new members to their cause.

In the intelligence assessment issued to law enforcement last week, Homeland Security officials said there was no specific information about an attack from right-wing extremists in the works.
The agency warns that an extended economic downturn with real estate foreclosures, unemployment and an inability to obtain credit could foster an environment for extremists to recruit new members who may not have been supportive of these causes in the past.

In November, law enforcement officials were seeing more threats and unusual interest against then- President-elect Barack Obama than ever before.
ThinkProgress notes some key take-aways from the report:

Anti-immigration: “Rightwing extremist groups’ frustration over a perceived lack of government action on illegal immigration has the potential to incite individuals or small groups toward violence. If such violence were to occur, it likely would be isolated, small-scale, and directed at specific immigration-related targets.”

Recruiting returning vets: “Rightwing extremists will attempt to recruit and radicalize returning veterans in order to exploit their skills and knowledge derived from military training and combat.”
Gun-related violence: “Heightened interest in legislation for tighter firearms...may be invigorating rightwing extremist activity, specifically the white supremacist and militia movements.”

The report is getting a lot of push back from angry conservative bloggers like Michelle Malkin:
By contrast, the piece of crap report issued on April 7 is a sweeping indictment of conservatives. And the intent is clear. As the two spokespeople I talked with on the phone today made clear: They both pinpointed the recent "economic downturn" and the "general state of the economy" for stoking "rightwing extremism." One of the spokespeople said he was told that the report has been in the works for a year. My b.s. detector went off the chart, and yours will, too, if you read through the entire report -- which asserts with no evidence that an unquantified "resurgence in rightwing extremist recruitment and radicalizations activity" is due to home foreclosures, job losses, and...the historical presidential election.
Moe Lane from RedState.com asks "Are you a Rightwing Extremist, too?":

Why? Well, it's a document that discusses the potential threats that we can expect from "rightwing extremists" (no hyphen, for some reason) in the coming months; there's the usual stuff about guns, illegal immigration, and disgruntled war veterans, plus the new wrinkle of our having elected an African-American President. The report concludes, unsurprisingly, that we have to worry more about "lone wolves and small terrorist cells" than anything else.

Hey Democrats - Lets get together and start mailing teabags to Republican representatives.  Sound like fun?
First, this was a Libertarian Party event that had gone unnoticed for decades, because of the LP's lack of numbers and corresponding lack of media coverage.

The LP has always tried to figure out workarounds to compensate for its size and lack of name brand awareness, so whenever they can figure out a gimmick to put them in contact with lots of people - like those going to the post office on April 15 - they do it.

Second, its stunning to watch the GOP now adopt LP gimmicks. Really stunning. Maybe they are hell-bent on becoming as irrelevant and gimmicky as the LP.

Third, the GOP is making a tactical mistake, I believe. By hitting Obama on fiscal issues, they are increasing the expectations of fiscal conservatives that the reign of social conservatives within the party is waning. Those rising expectations are the de Tocquevillian danger.

What happens when in three years a fiscal conservative isn't the front runner for the presidential nomination?

I see a danger from the GOP perspective that many of those fiscal and libertarian Republicans may bolt the party, back an independent, etc.

There's also a broader danger. If the economy improves in three years, Obama will be in a very good position for re-election. If it doesn't, he won't be. Its probably going to improve, regardless of what the federal government does. And if it does, some even obscene deficit spending will be forgiven, so long as it looks like it was in the context of dealing with an economic emergency.

By staking the GOP's future on opposing federal spending and tax rates that are lower than when Reagan was in office, the GOP seems poised to take itself even further out of mainstream conventional wisdom, and make itself seem all the more hypocritical (because we didn't see any interest in protesting Bush Administration over-spending).
The thing is people are fed up with the waste of our tax money. middle america is over burdened with taxes. Federal tax and then add huge state taxes being added make it impossible for middle america to continue carrying the burdon. If Oboma is afraid of the questions that would be asked about his agenda by republicans then maybe he does have something to hide? Now on top of this he will pardon the illegals and Americans will be out again.
Here is another great example of how the media is covering the tracks of our politcal leaders in Washington as well as our state leaders.  Blame it in the Republicans, what you fail to see is the difference between the RNC using this event to better its position and the RNC creating this event.  This is a grass roots uprising that is being conducted by taxpayers who are saying "enough" to the current policy of just increase the tax on the individual to pay for the programs that we just don't need or want.  Wake up and smell the roses before you walk off a cliff because of your blind support of these programs.
Is Chuck Todd an actually reporter or a mouth piece for the DNC? He's more of a Cheerleader for the Democrats then a reporter. Why?

Shad Planking sounds fishy to me, is that like a Fish Fry?  I hope that McAuliffe wins big today and that the repugnant one McDonnell comes in dead last.  If it's an acquired taste then I'm glad we don't do shad planking here in CA.

Yippee Murphy has extended his lead over the Bernie Madoff clone!  So funny that this race is even close and that Murphy is leading in a district with a 70,000 registered voter edge for the Irrelevant Elephants.  Keep dissing Obama and we'll be taking districts in the south come next year.

These losers (whose archetype is joe the non-plumber) ALL got a tax cut under the new administration since  I guarantee none make more than 50 grand (let alone $250K).  This group, along with Gingrich, Palin, Limbaugh et al will be responsible for the approaching death of the gop

If by "grassroots" you mean that the Tea Parties will likely devolve into a gathering spot for hate groups and conspiracy theorists, then...yeah, sure.

I'd love to know what it is exactly that's being protested today- no one can give a clear answer on that issue.  Is it current taxes- if so, do these people realize that they are still paying Bush-imposed taxes?  Is it "big-government spending"- which our President eloquently pointed out is necessary when our economy is contracting so severely?  Or is it the typically greedy, self-absorbed nonsense from people that are perfectly happy to benefit from various government programs, yet don't want to actually have to pay for them?

Of course, if you ask the actual organizers of these things, their dirty little secret is that they just want to hold onto their millions (billions?) while they scam the people who would actually benefit from President Obama's tax cuts to do the legwork for them- and they hide in the shadows.
I hope everyone asks themselves, did I use my vote last election to change the congress or did I vote for the incumbent, self-serving politician, be it a Republican or Democrat , who has become entrenched in office.  How is it that congress had a 12% approval rating yet 96% were reelected? The "my congressman is ok, it's all the others that are the problem" syndrome was, as always, in play. These politicians need to loose there job! They are responsible for the state of this country. The American people have gotten the Government that they deserve. Next election, vote against all incumbents, or look in the mirror to see the real problem.
Of course a 48% think that the tax they pay is just about right, when 50% don't pay income taxes at all.  Amazing poll numbers. Get real.  I think you at CNN just don't grasp the strength that the Tea partis are gaining.  I'm a retiree, female, lower middle class and am attending my first protest ever.  I don't see much of a future for my children, grandchildren and great grandchildren with the direction this administration is taking our country.  Don't label me a racist for not supporting Obama's policies.  I could care less.  I have a Black future son in law I love, a Hisplanic future son in law I love and two Puerto Rican adopted grandchildren who are the light of my life.  I judge people for who they are, not what color or ethic group they may be. If this makes me a right wing extremists, bring it on.

'...Judgment Day for Tax Cheats

One wonders if Phil Gramm has been made just a tad nervous by the news on Tuesday that one of UBS' super-wealthy private clients has pleaded guilty to tax evasion. That's the second case in two weeks involving the bank at which the former senator is a vice chairman, and 100 other clients are under investigation for possible bank-assisted tax fraud.

Robert Scheer: GOP "tea-baggers" take note: The Justice Department is closing in on offshore tax cheats. And former Sen. Phil Gramm, their chief enabler, could be caught in the net.

Gramm, the Republican former chair of the Senate Finance Committee, where he authored much of the deregulatory legislation at the heart of the current banking meltdown, has for the six years since he left office helped lead a foreign-owned bank specializing in tax dodges for the wealthy. These schemes by the Swiss-based UBS not only force the rest of us taxpayers to pay more to make up the government revenue shortfall but are blatantly illegal. In February, UBS admitted to having committed fraud and conspiracy and agreed to pay a fine of $780 million. Republican "Tea Baggers" take note: Offshore tax havens do not equal populist revolt.

In the UBS "deferred prosecution agreement" with the Justice Department, the bank agreed to turn over the names of its secret account holders to avoid a criminal indictment. The complicity of top executives in this far-ranging scheme to use foreign tax havens to cheat the US treasury of billions in uncollected taxes was noted at the time in a Justice Department statement: "Swiss bankers routinely traveled to the United States to market Swiss bank secrecy to United States clients interested in attempting to evade United States income taxes."

What did Gramm think all of those Swiss bankers from his firm were doing over here? Was he totally clueless? The Justice Department statement suggests otherwise: "UBS executives knew that UBS's cross-border business violated the law. They refused to stop this activity, however, and in fact instructed their bankers to grow the business. The reason was money--the business was too profitable to give up. This was not a mere compliance oversight, but rather a knowing crime motivated by greed and disrespect of the law."

Is it conceivable that this "knowing crime," so widespread within the UBS enterprise, was unknown to Vice Chairman Gramm--even though it primarily involved US tax evasion, and he had been hired by the company because of his expertise in American law, some of which he helped to write? As Gramm said when he was hired in 2002 by UBS, the position "will provide me with the opportunity to practice what I have always preached. I have been involved in every major financial debate since I've been in the Congress."

How could Gramm, who prides himself on expertise in these matters, have been unaware of the damage that the Swiss bankers who worked for him were doing to American taxpayers saddled with making up the shortfall in government revenue? As the Justice Department said: "In 2004 alone, Swiss bankers allegedly traveled to the United States approximately 3,800 times to discuss their clients' Swiss bank accounts. The information further alleges that UBS managers and employees used encrypted laptops and other counter-surveillance techniques to help prevent the detection of their marketing efforts and the identities and offshore assets of their U.S. clients."

But then again, if you are Phil Gramm or his wife, Wendy, you might expect to get away with a great deal in the way of financial machinations. After all, neither has ever been held legally responsible for the Enron debacle, in which the Gramms played a major part.

As a top government regulator, Wendy Gramm changed the rules to make Enron's chicanery possible, and as the chairman of the Senate Finance Committee, Phil codified those rule changes into federal law. While Enron execs like Chairman Ken Lay (a major Gramm campaign contributor) were indicted, the charmed couple that created the loopholes Lay and others jumped through escaped legal responsibility.

After leaving the government, Wendy Gramm joined Enron's board, where she headed the audit committee that managed to avoid auditing the company's disgraceful accounting procedures--just as her husband has apparently looked the other way during his stint in the private sector with UBS...'
