Souter to retire? Maybe, maybe not

The AP is running a story this afternoon that raises the question of whether Supreme Court Justice David Souter might retire.

Answer: He might. Then again, he might not.

Here's the background: Souter is usually the last of the justices to hire law clerks for the coming term. He typically gets around to it in March or April -- well after the other justices have chosen theirs. But this year, Souter hasn't done it yet, and that has been the subject of gossip in legal circles.

Those familiar with Souter's practices say he asked around for names of potential candidates for clerks earlier this year, a sign he was thinking of staying on the court.  But it's not clear yet that he has actually interviewed them, which might be a sign that he's considering retirement. It might be that he's just late in attending to clerk duty this year. Souter's chambers are saying nothing, not even giving winks or nods for guidance.

Clerk-ology is an undependable indicator of a pending retirement. Some justices have decided to retire even after hiring clerks, who then go on to work for the retired justice.

If anyone were to retire this term, Souter has long been thought to be the likely one. John Paul Stevens, at 89, is the court's oldest. But he is, in the view of many, at the top of his game, a master court strategist at assembling votes. Next oldest, at 76, is Ruth Bader Ginsburg. But anyone who thinks she might retire wasn't watching when she made her triumphant return during President Obama's speech to Congress. 

Souter, at 69, is a comparative youngster, the 5th oldest on the court.

Typical of tabloid journalism. Somebody changes their routine and all of a sudden it is a sign that something big is about to happen. Maybe it is and maybe it isn't but before reporting it why not wait until it happens. I understand the desire for the "scoop" in journalism but someimes in the interest of being the first to blab the latest SO CALLED journalists get carried away.

Suppose Souter does retire what are the ramifications? How could the court change? Who else could possibly leave the Court in the next few years? What would the impact of that be. Asking questions like this gets possible answers, gets folks thinking, is interesting. Gossip is simply that, gossip.
Please Justices, Don't retire for the next four years. I can only imagine what kind of activist judges that Obama would appoint.
Maybe Obama should move on. He is shooting to be King of the World. Now may be the right time for him to do that. He is popular you know.

I absolutely agree: PLEASE DON'T RETIRE, JUSTICES! Obama, unfortunately, has made statements very clearly indicating he would favor justices that "seek justice for the victim", and not, alternatively a justices that "seek justice through the constitution". He'll nominate justices who will skew the constitution however to extremes to justify political demagoguery.
NO BIG LOSE.   OBAMA CAN THEN NAME GEORGE SOROS TO THE COURT.
Can we get Roberts, Alito, Thomas and Scalia impeached first?
Sure hope that SOMEONE retires so we can have a "fair-and-balanced" Supreme Court.  BTW, anybody see Snotty, Petulant Pat Buchanan snipe at the gracious, intelligent Jonathan Turely tonight on "Hardball"?  Just another GOP victim.  C'mon, MSNBC - give Lawrence O'Donnell a show!

"Activist Judge" meaning anyone who doesn't lock step with the GOP and its wishes.

This just in...The Founding Fathers specifically created the Judicial Branch (see also: The Supreme Court) as one of the checks and balances in this nation's government meaning that, by its nature, The Supreme Court should be chock full of Activist Judges.

What a shame that we have Supreme Court Justice Clarence Thomas.  The next time he formulates his own legal opinion will be the first.
I wonder if the Republicans will try to filibuster Obama's nominee the way the Democrats filibustered Bush's?

find a nice young far left judge who can anchor the bench for the next 40 years.  by then they will be on the right side of the bench.  

That is because as time progresses society progresses and so do our views - think about the common ideas on racial issues 40 years ago versus now.  
This is the benefit to putting liberal judges on the bench - as time goes on they begin at the left, move to the center and if they sit on the bench long enough will end up on the right.  Judges who start at the center or right tend to (although is not always the case since Souter doesn't follow this)move further and further right.

So Pres. Obama use that 60 vote senate and find the most progressive judge you can.
What's the point of writing a story on something that may or may not be true. I may or may not win the lottery tomorrow but until the numbers are revealed there is no story!!
DG in Houston, why is it that a judge is only considered an "activist" if s/he is a Democrat? Do you define an "activist" judge as one whose rulings you don't like?
Obama has to find a judge who would approve the violation of law that he supports:  giving GM and Chrysler to the UAW as a campaign bayback while making secured debt holders take pennies on the dollar.  No judge would ever approve this deal if he graduated from law school.  Maybe Obama will pick Supreme Court Justice Hugo Chavez.
DG - Take a deep breath. Souter was appointed by a Republican who thought he'd vote accordingly. Often he didn't.

There is no guarantee if President Obama appoints a progressive or a liberal that the votes will always go that way.

Also, I think we have seen that President Obama does not take important things like this lightly. I bet he puts a great deal of thought into this appointment. I also do not think he will have a litmus test per abortion, etc. I think he wants someone who knows the law, the Constitution, and will rule accordingly.

One of the greatest Supreme Court Justices was Sandra Day O'Connor. Although liberals would consider her too far right, she really ruled in the middle. She was thoughtful about each of her decisions and did not necessarily think about party.

Except for the 2000 election. But I bet a lot of justices regret that decision.

Typical double standard, double talking Democrats. You think equality of outcomes is more important than equality of opportunity. Either you take race, color, religion, sex, or national origin into consideration when hiring or you don’t. You can’t have it both ways when it suits your PC whims.

The law is very clear: “It shall be an unlawful employment practice for an employer to limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, religion, sex, or national origin.”


To DG, Houston, TX: One things for sure they'll be 100% better than Bush's appointments.
