The best way to illustrate U.S, power is through its utilization of its constitution. In this case we provide our suspected adversaries right to counsel and right to fair trial. Kangaroo courts should never be allowed. We should never be afraid of our impartial justice system. It is one of the strengths and pillars of our representative democracy. I have full faith that by providing these safeguards will not harm national security or allow them to "be set free" if guilty. If ,has been the case in some of the detainees , they are not guilty then we illustrate to our enemies we apply a fair a justice system. To do other is to embrace our enemies values and not ours. This enhances our prestige not weakens it. The days of fear needs to end. I would like to know Mr. McCain's stance?

I firmly believe that the government has the responsibilty to protect it's citizens.

I agree with Gary that the military has changed a lot since I served. But the civilian "leadership" has changed a lot too. Neither Bush nor McCain are anything that closely represents someone like Ronald Reagan. He was a realist and a pragmatist which is why he could get things done.

The Bush administration and a McCain administration would be riddled with ideologs and the geniuses from the American Enterprise Institute, the people who brought us the Iraq War, and being greeted as liberators among other policy blunders.

I have a close blood relative who works as DOJ in their upper eschelons and has become increasingly more biased, irrational and even unstable in his views about human rights and terrorism. This person actually believes that torture is ok and provides reliable information.

It's even scarier that he believes that all information he sees (with his "top TOP secret clearance") is actually 100% accurate. WMD anyone? Bush Lies anyone? Incompetence anyone?

This is a clear message that the configuration of the Supreme Court after Bush leaves office is a HUGE question in this election cycle. This decision is surprising out of a Republican stacked court, but thankfully the Law has prevailed. One of the most important things that Obama can do is start to appoint "younger, more liberal" justices to replace Ginsburg and Stevens, and any others that retire during his (terms) in office.

You people seem to be forgetting that these terrorists were not detained by a police officer in Anytown USA. They were detained in foreign countries by the armed forces and as such they do not have constitutional rights. They are also unlawful combatants which means that the Geneva Conventions DO NOT APPLY...look up the definition of a unlawful combatant and you will see they are not entitled to Geneva Conventions or constitutional rights. They are allowed to be detained for the duration of the conflict they were captured in without a trial.
