Obama said in Milwaukee: "If I am the nominee, then I will make sure that our people talk to John McCain's people to find out if we are willing to abide by the same rules and regulations in respect to the general election." But, he added, "it would be presumptuous of me to start saying now that I'm locking myself into something when I don't even know if the other side is going to agree to it, and I'm not the nominee."

That doesn't sound like someone who agreed to use the public financing system.

First Read--I believe that you are missing an important element of the story. Wasn't there an issue to the FEC not having quorum--enough members to hear the case because George W. Bush hasn't filled the spots? Basically George Bush is doing his best to protect McCain from losing this case. They are attempting to stall and obfuscate things long enough so that by the election it will be a moot point and McCain can't be punished for cheating.

It should be very simple, John McCain gamed the system by using the public funds as collateral to receive a loan. This is true and can be proven. The point is if he didn't illegally use the prospect of public financing, he would have never been approved for that loan. That loan kept his campaign afloat and maybe could have altered the outcome of his GOP nomination. Even though he didn't use the public funds, he used the promise of them to cheat the system and he DID use the ill-gotten money. I hope some journalists will do some research to find out if a potential presidential candidate is in violation of the law.

Even if he received no direct funds, the fact is that a number of states waive their filing fees for a candidate who's publicly financed. Such fees WERE waived for McCain after he had stated he was being publicly financed. This is a direct financial benefit that McCain got due to initially opting in. So, once he opted out, he became a crook, a lawbreaker. Simple as that.

Obama changes his mind. McCain breaks the law. Not quite the same thing.
