Looks like the weekly standard has done some substandard reporting here. Since Miranda Rights apply to US citizens there's really no reason to give them to terrorists captured on foreign soil. However for those caught here they should get the Miranda Rights read to them because that is the law of this land of laws.

I'm glad that President Obama is making Afghanistan and Pakistan the central front on the war against the Taliban and Al Qaeda. Those two countries have always been the central front on the war against these terrorist groups and Iraq was a distracting sideshow that Warmongers Bush and Cheney fell for because they were after oil and allowing Halliburton, KBR and Blackwater to rip us taxpyers off.

The Justice Department says there has been no change in policy on giving Miranda warnings to detainees picked up in Afghanistan.

Does this surprise me...no. I am waiting to hear about the ruling on the release of the torture memos. I really do think that it is a bad idea to release certain documents pretaining to the torture of detainees at Gitmo. It is something that I feel will cause more harm to our servicemen and women than any terroist can ever inflict.

There are some thing that are best kept away from media scruity because everyone isn't responsible. Commentators such as Rush and Fox noise has proved that. What will some of them say when perhaps thousands are killed due to their spin? This is not a good idea.

Good question. Terrorists have been tried in the US before. The problem with trying the Gitmo detainees is 1) There are a lot of them and 2) A trial in civil court is a lot different then in military court.

In civil court, the suspect is charged, a trial is held, evidence is produced, a defense is made, and a judge/jury decides the fate of the accussed. The problems though are many. First, rules of evidence are much different for civil trials. When a crime is committed in the US, evidence teams are dispatched and interviews with witnesses are conducted. These two things don't happen on the battlefield though. You may capture a terrorist out on the battlefield where bombs are bullets are destroying any evidence against the terrorist. Interview? Who are you going to interview? So now you're trying to fit a square peg in a round hole. You are attempting to try a military combatent in a civil trial using the rules of evidence for civilians. More then likey the prosecutor doesn't have that level of evidence.

The ohter problem is that the trial is conducted in public. Doing so brings out the US's strategy, techniques, and intelligence gathing oeprations into the public. Doing so provides the enemy with a treasure of information on how to avoid such things in the future.

Bringing terrorists to the for trial in civil courts is a really bad idea.

Think back to the days of the Contra rebels and the U.S. people advising them. Suppose some U.S. citizens had been captured as "enemy combattants" and sent to a prison on the Falklands Islands, where they were held indefinitely and without charges being brought. What would President Reagan have done? Would he have let them waste away there, or would he have pushed to get them rights, and get them off the island? Would he have appealed to international rules of law?

This article seems a bit confusing. It says Obama ordered a change yet says it is not a change from Bush's policy, and no new policy directive will be issued. I get it but it sounds odd. It only stands to reason that the FBI would read Miranda rights to foreigners. If there is a trial in US courts, Miranda rights would be an issue. No doubt the foreign terrorists who were tried, convicted and currently in prison were given Miranda rights.

Not wasting my time in answering comments about tucking terrorists in bed because such thinking is just pathetic and unfounded jibberish.

That's not what it says at all. It's actually quite confusing. Information on what Obama has done, both as stated om this article, and other articles, consuing and contradictory at best.

And by bringing a terrorist to NY for trial, Obama has provided additional rights to that terrorist. The rules and rights to an accused are much different in the US in a civil trial then they are in Gitmo with a military trial.

1). What rule of Law would be used for Gitmo for example, Ours, International, or where they were captured.

2). What is it going to cost to try 200 people, including appeals?

3). How can prosecuters be effective digging up this evidence now to put on a case?

4). Where will they house them PRIOR to trial?

5). How do the determine which prosecuting team has the expertise to try these cases?

6). With our court system already backed up, what is the impact to this?

7). Dealth penalty on the table?
