This whole dance business is just Republican nonsense. Judge Sotomayer is much more qualified than Justice Thomas and everyone knows it. The American people are watching and if the Republicans and especially Sessions continue this nonsense the American voters will make them pay in 2010 and 2012. They need to confirm Judge Sotomayer and move on to pressing matters of Healthcare reform and an Energy Plan.

"Empathy" has no role in the rule of law. In actuallity, jurisprudence empathy is the antithesis to the "Rule of Law".

The Rule of Law requires that we understand the rules PRIOR to engaging in any activity. And in the Ricci case. Sotomayor changed the rules mid-way through the process of selecting firefighters. She wanted to change the test. That's all fine and good, but wait until the current testing process is complete before allowing others to change the rules (i.e. the test).

This is the same as most of us understanding the 65 mph speedlimit. Yet, a cop pulls you over says he "feels" the speed limit should be 45 through the given section of highway in which you were travelling on.

Watching Sotomayor hearings, it is clear her level of intellect and thought process poses a challenge to some of the senators interviewing her. There certainly is a disconnect demonstrated by the senator's lack of understanding regarding the concept of 'insight'. How one's own gatekeeping of biases, must be a conscious and ongoing process when engaging in critical thinking and decision making seems to be beyond the grasp of some lawmakers on the cmte. The hearings are serving to be an interesting measure of the committee members' intellect and ability in fulfilling this particular duty. I find it disappointing and hope others will remember this when the next election rolls around.

A) Rush is an arse'hole
B) Rush doesn't make the rules.
c) If you remember.....the judicial fillibuster was preserved when the "Gang of 12" (or how many of them there were...) reached a compromise and allowed a couple of Bush's nominees to be seated on the Federal "Bench."
Anyboody who makes the kind of statement she did, about a "Latina' Woman" being a better judge of the law than "white males" should not be a judge at ANY level, federal, state, or municipal
