The second stage is called conviction.&lt;br&gt;Impeachment is so rare that the term is often misunderstood. A typical misconception is to confuse it with involuntary removal from office; in fact, it is only the legal statement of charges, paralleling an indictment in criminal law. An official who is impeached faces a second legislative vote (whether by the same body or another), which determines conviction, or failure to convict, on the charges embodied by the impeachment. Most constitutions require a supermajority to convict.&lt;br&gt;In the United States, impeachment can occur both at the federal and state level. At the federal level, different standards apply when the impeachment involves a member of the executive branch or of the judiciary (and dispute currently exists over the use of impeachment against members of the legislative branch). For the executive branch, only those who have allegedly committed &amp;quot;treason, bribery, or other high crimes and misdemeanors&amp;quot; may be impeached. Although treason and bribery are obvious, the Constitution is silent on what constitutes a &amp;quot;high crime or misdemeanor.&amp;quot; Several commentators have suggested that Congress alone may decide for itself what constitutes an impeachable offense. In 1970, then-Representative Gerald R. Ford defined the criteria as he saw it: &amp;quot;An impeachable offense is whatever a majority of the House of Representatives considers it to be at a given moment in history.&amp;quot; Four years later, Ford would assume the Presidency, following the resignation of President Richard Nixon. (Nixon resigned following a committee vote to approve impeachment proceedings, but before actual impeachment by the full House.)&lt;br&gt;The Constitution grants to the House the power to impeach &amp;quot;The President, the Vice President, and all civil Officers of the United States.&amp;quot; Jefferson's Manual, which is integral to the House rules, states that impeachment is set in motion by: charges made on the floor; charges preferred by a memorial; a Member's resolution referred to a committee; a message from the President; charges transmitted from the legislature of a State or territory or from a grand jury; or from facts developed and reported by an investigating committee of the House. It further states that a proposition to impeach is a question of high privilege in the House and at once supersedes business otherwise in order under the rules governing the order of business.&lt;br&gt;The impeachment procedure is in two steps. The House of Representatives must first pass &amp;quot;articles of impeachment&amp;quot; by a simple majority. (All fifty state legislatures as well as the District of Columbia city council may also pass articles of impeachment against their own executives.) The articles of impeachment constitute the formal allegations. Upon their passage, the defendant has been &amp;quot;impeached.&amp;quot;&lt;br&gt;Next, the Senate tries the accused. In the case of the impeachment of a President, the Chief Justice of the United States presides over the proceedings. Otherwise, the Vice President, in his capacity as President of the Senate, or the President pro tempore of the Senate presides. This may include the impeachment of the Vice President, although legal theories suggest that allowing a person to be the judge in the case where she or he was the defendant wouldn't be permitted. If the Vice President did not preside over an impeachment (of someone other than the President), the duties would fall to the President Pro Tempore.&lt;br&gt;In order to convict the accused, a two-thirds majority of the senators present is required. Conviction automatically removes the defendant from office. Following conviction, the Senate may vote to further punish the individual by barring them from holding future federal office (either elected or appointed). Despite a conviction by the Senate, the defendant remains liable to criminal prosecution. It is possible to impeach someone even after the accused has vacated their office in order to disqualify the person from future office or from certain emoluments of their prior office (such as a pension). If a two-thirds majority of the senators present does not vote &amp;quot;Guilty&amp;quot; on one or more of the charges, the defendant is acquitted and no punishment is imposed.&lt;br&gt;Congress regards impeachment as a power to be used only in extreme cases; the House has initiated impeachment proceedings only 62 times since 1789 (most recently President Clinton)&lt;br&gt;Two presidents: &lt;br&gt;o	Andrew Johnson was impeached in 1868 after violating the then-newly created Tenure of Office Act. President Johnson was acquitted of all charges by a single vote in the Senate. &lt;br&gt;o	Bill Clinton was impeached on December 19, 1998 by the House of Representatives on grounds of perjury to a grand jury (by a 228–206 vote) and obstruction of justice (by a 221–212 vote). Two other articles of impeachment failed—a second count of perjury in the Jones case (by a 205–229 vote), and one accusing President Clinton of abuse of power (by a 148–285 vote). Gonzo is holding out until the Congress goes into recess. Then he'll step down and Bush will make a recess appointment (which doesn't require Senate approval). This allows the white house to avoid the two things they fear most, an impartial independent AG and his appointment dependant on him setting up an independent investigation into the Justice dept. &lt;br&gt;The Director in Washington D C of the Dept of Justice &lt;br&gt;replaced the Region 3 Trustee on Dec 22 2004, &lt;br&gt;The Asst US Trustee did place a Motion to Disgorge &lt;br&gt;for $1.6 million in the eToys case 01-706.&lt;br&gt;Just 10 days later the US Attorney for the US Trustee&lt;br&gt;Office sought to Settle that Disgorge Motion.&lt;br&gt;The Settlement violates the LAW.&lt;br&gt;We complained to the Asst US Trustee and the Director&lt;br&gt;in Washington DC of the EOUST.&lt;br&gt; &lt;br&gt;Both resigned after the Stipulation to Settle was placed&lt;br&gt;into the record.&lt;br&gt; &lt;br&gt;The following facts below are verified by Court docket records.&lt;br&gt; &lt;br&gt;Would you consider an article on your blog on the subject of the case&lt;br&gt;and the US Trustee's refusal to prosecute?&lt;br&gt; &lt;br&gt;We have proof the Dept of Justice management has lost its sense of honor and duty.&lt;br&gt;&lt;br&gt;In the Bankruptcy case of eToys 01-706 (DE 2001) we proved over 100 felony violations by the firm of Traub Bonacquist &amp;amp; Fox and Morris Nichols Arsht &amp;amp; Tunnel.&lt;br&gt;&lt;br&gt;The US Trustee is charged by the Janet Reno Reform Act of 1994 to be the &amp;quot;policing&amp;quot; &amp;quot;watchdog&amp;quot; of public entity bankrupt estates to protect equity holders.&lt;br&gt;&lt;br&gt;The LAW of 18 USC 3057(a) and 28 USC 586(a)(3)(F) mandates that the US Trustee officially report all malfeasance by any attorney in a bankruptcy case to the US Attorney office for prosecution.&lt;br&gt;&lt;br&gt;When we placed proofs of the &amp;quot;non disclosure&amp;quot; of &amp;quot;conflict of interest&amp;quot; into the record the Director of the EOUST in Washington D C then replaced the Region 3 Trustee on Dec 22 2004 (you can go to the US Trustee website and see the press release)&lt;br&gt;&lt;br&gt;&lt;br&gt;Then on Feb 15 2005 the Asst US Trustee placed a Disgorge Motion against Traub Bonacquist &amp;nbsp;(TBF) into the record for $1.6 million.&lt;br&gt;(docket item 2195)&lt;br&gt;&lt;br&gt;The Asst US Trustee stated that he had [fore]warned the parties not to replace any key personnel of the debtor with anyone connected to the retained professionals of the estate(which are thereby Officers of the Court).&lt;br&gt;(please see Disgorge Motion parts 19 and parts 35)&lt;br&gt;&lt;br&gt;Despite that warning the parties of TBF as creditor's counsel and &amp;nbsp;debtor's counsel Morris Nichols Arsht &amp;amp; Tunnel (MNAT) did collaboratively draft a HIRING LETTER for Barry Gold.&lt;br&gt; (Traub has admitted to paying Barry Gold 4 separate payments of $30,000 each, both pre and post petition)&lt;br&gt;(please see March 1, 2005 Transcript docket items 2228)&lt;br&gt;&lt;br&gt;The HIRING LETTER was never revealed until after the deceptions of non disclosure of conflict of interest were proven.&lt;br&gt;&lt;br&gt;The HIRING LETTER was used by TBF and MNAT to place Barry Gold in as the &amp;quot;wind-down coordinator&amp;quot; of eToys.&lt;br&gt;&lt;br&gt;The HIRING LETTER also contained and illegal clause that brazanly REwarded Barry Gold for not seeking the Court's approval of his hiring by then giving him the CEO and Presidents Job.&lt;br&gt;&lt;br&gt;When Traub stopped paying the $30,000 per month, TBF and MNAT had designed that the ESTATE pay Barry Gold $40,000 per month.&lt;br&gt;&lt;br&gt;All this is admitted and in the record.&lt;br&gt;&lt;br&gt;The Asst US Trustee also stated that the acts of non disclosure were deliberate, rather than inadvertent, that it was by vastly experienced bankruptcy counsels, that it destroyed the line between Creditor v Debtor, that repetitive affirmative misrepresentation of Rule 2014(Perjury) acts had occurred. That &amp;quot;this is all that is necessary to prove Fraud upon the Court&amp;quot;&lt;br&gt;&lt;br&gt;Now the Asst US Trustee sought silently to be lenient by not seeking the mandatory disqualification that is required by Code 327(a) as established by the 3rd Circuit and the Supreme Ct (In re Middleton Arms)&lt;br&gt;&lt;br&gt;Then less than 10 days later, the US Attorney for the new Region 3 Trustee placed a Stipulation &lt;br&gt;to Settle for only $750,000 into the record.&lt;br&gt;&lt;br&gt;The Stipulation to Settle also contains ILLEGAL clauses such as &lt;br&gt;&lt;br&gt;WHEREAS the United States Trustee shall NOT seek to compel TBF to make any additional disclosures.&lt;br&gt;&lt;br&gt;One of the Additional disclosures the AUSA seeks to help hide is the fact that Barry Gold, MNAT and TBF all have &amp;quot;undisclosed&amp;quot; connections to KB Toys and their owner(s).&lt;br&gt;&lt;br&gt;As eToys sold the bulk of their assets to KB Toys and their owners such is NOT a &amp;quot;bona fide&amp;quot; sale and is rescindable.&lt;br&gt;&lt;br&gt;It is also Collusion to Defraud an Estate.&lt;br&gt;&lt;br&gt;&lt;br&gt;We complained to the Director of the EOUST, the Asst US Trustee and the head of President Bush's Corporate Fraud Task Force.&lt;br&gt;&lt;br&gt;All 3 parties have resigned.&lt;br&gt;&lt;br&gt;We also contacted the SEC Bankruptcy Fraud Div in Atlanta GA where we were told they would send the AUSA for Region 3 an Official Intergovernmental Letter for Official Investigation.&lt;br&gt;&lt;br&gt;The US Attorney for the Region 3 Trustee told the SEC not to send the Letter.&lt;br&gt;&lt;br&gt;Other OBSTRUCTIONS by the US Attorney for Region 3 also included aggressive acts to strike and expunge all the proofs we place into the record.&lt;br&gt;&lt;br&gt;Stating that Article III does not apply to bankruptcy proceedings and that we must have their permission to point out fraud to the court.&lt;br&gt;&lt;br&gt;We also contacted the FBI, the Public Integrity Section of the DOJ, the US Marshalls, the OGE, the OPR, the ORO, the OIG and more.&lt;br&gt;&lt;br&gt;All referred us to the US Dept of Justice EOUST General Counsel's office.&lt;br&gt;&lt;br&gt;The problems is, after the Asst US Trustee and the Director of the EOUST resigned.&lt;br&gt;&lt;br&gt;Alberto Gonzales office Promoted the former REMOVED Region 3 Trustee to the position of Acting General Counsel&lt;br&gt;&lt;br&gt;She is in charge of investigating her own case.&lt;br&gt;&lt;br&gt;If you want to see where the power and influence comes from guess who owns KB Toys, Stage Stores and more.&lt;br&gt;&lt;br&gt;How is it possible that the shareholders of eToys are thrown away, when the Bankrupt estate can now be made whole by causes of actions&lt;br&gt;&lt;br&gt;While eToys is now a Public Equity again merging with Baby Universe on NASDQ symbol&lt;br&gt;POSH.&lt;br&gt;&lt;br&gt;</description></item><item><title>Impeach Gonzales?</title><link>http://firstread.msnbc.msn.com/archive/2007/07/30/297411.aspx#305143</link><pubDate>Mon, 06 Aug 2007 07:27:26 GMT</pubDate><guid isPermaLink="false">8a5d2dbc-a0e4-4c7a-979f-3188051f228e:305143</guid><dc:creator>A progressive voice, New York City</dc:creator><description>Impeach Gonzales, Cheney and Bush.
