In the constitutions of several countries, impeachment is the first of two stages in a specific process for a legislative body to remove a government official without that official's agreement. The second stage is called conviction.
Impeachment is so rare that the term is often misunderstood. A typical misconception is to confuse it with involuntary removal from office; in fact, it is only the legal statement of charges, paralleling an indictment in criminal law. An official who is impeached faces a second legislative vote (whether by the same body or another), which determines conviction, or failure to convict, on the charges embodied by the impeachment. Most constitutions require a supermajority to convict.
In the United States, impeachment can occur both at the federal and state level. At the federal level, different standards apply when the impeachment involves a member of the executive branch or of the judiciary (and dispute currently exists over the use of impeachment against members of the legislative branch). For the executive branch, only those who have allegedly committed "treason, bribery, or other high crimes and misdemeanors" may be impeached. Although treason and bribery are obvious, the Constitution is silent on what constitutes a "high crime or misdemeanor." Several commentators have suggested that Congress alone may decide for itself what constitutes an impeachable offense. In 1970, then-Representative Gerald R. Ford defined the criteria as he saw it: "An impeachable offense is whatever a majority of the House of Representatives considers it to be at a given moment in history." Four years later, Ford would assume the Presidency, following the resignation of President Richard Nixon. (Nixon resigned following a committee vote to approve impeachment proceedings, but before actual impeachment by the full House.)
The Constitution grants to the House the power to impeach "The President, the Vice President, and all civil Officers of the United States." Jefferson's Manual, which is integral to the House rules, states that impeachment is set in motion by: charges made on the floor; charges preferred by a memorial; a Member's resolution referred to a committee; a message from the President; charges transmitted from the legislature of a State or territory or from a grand jury; or from facts developed and reported by an investigating committee of the House. It further states that a proposition to impeach is a question of high privilege in the House and at once supersedes business otherwise in order under the rules governing the order of business.
The impeachment procedure is in two steps. The House of Representatives must first pass "articles of impeachment" by a simple majority. (All fifty state legislatures as well as the District of Columbia city council may also pass articles of impeachment against their own executives.) The articles of impeachment constitute the formal allegations. Upon their passage, the defendant has been "impeached."
Next, the Senate tries the accused. In the case of the impeachment of a President, the Chief Justice of the United States presides over the proceedings. Otherwise, the Vice President, in his capacity as President of the Senate, or the President pro tempore of the Senate presides. This may include the impeachment of the Vice President, although legal theories suggest that allowing a person to be the judge in the case where she or he was the defendant wouldn't be permitted. If the Vice President did not preside over an impeachment (of someone other than the President), the duties would fall to the President Pro Tempore.
In order to convict the accused, a two-thirds majority of the senators present is required. Conviction automatically removes the defendant from office. Following conviction, the Senate may vote to further punish the individual by barring them from holding future federal office (either elected or appointed). Despite a conviction by the Senate, the defendant remains liable to criminal prosecution. It is possible to impeach someone even after the accused has vacated their office in order to disqualify the person from future office or from certain emoluments of their prior office (such as a pension). If a two-thirds majority of the senators present does not vote "Guilty" on one or more of the charges, the defendant is acquitted and no punishment is imposed.
Congress regards impeachment as a power to be used only in extreme cases; the House has initiated impeachment proceedings only 62 times since 1789 (most recently President Clinton)
Two presidents:
o Andrew Johnson was impeached in 1868 after violating the then-newly created Tenure of Office Act. President Johnson was acquitted of all charges by a single vote in the Senate.
o Bill Clinton was impeached on December 19, 1998 by the House of Representatives on grounds of perjury to a grand jury (by a 228–206 vote) and obstruction of justice (by a 221–212 vote). Two other articles of impeachment failed—a second count of perjury in the Jones case (by a 205–229 vote), and one accusing President Clinton of abuse of power (by a 148–285 vote). He was acquitted by the Senate.

On the ratings of Congress: you have to look at the figures. When you ask people "Do you support the Democrats in Congress," the numbers are more like 37% in favor. It's an old tactic, you know. Filibuster and delay, and then blame the inability of a bare Democratic majority to get above the 60-vote filibuster line on the Democrats, not the filibustering Republicans. The largest decrease in Congress's numbers come from antiwar people who are disappointed that the Democrats couldn't end the war.

Then he'll step down and Bush will make a recess appointment (which doesn't require Senate approval). The reason Bush will not replace Gonzales is that he knows his administration has commited crimes for which they could be held accountable, but as long as his old college buddy is in the A.G. position, he need not worry.

Anyone who could pass Senatorial approval would be less reliable and presumably more likely to take their job seriously.

On the up side, Bush might be better served having this stuff litigated while he still has some control over who will be leading the investigation. Once he leaves office, many of his administration may find themselves facing a decidedly less friendly AG.

The only reason why Congress's approval ratings are down is the failure to reverse Bush's Iraq policy. Unfortunately, the Democrats don't have the votes to override a Bush veto...many Americans don't have a clue concerning the workings of government. The only other option is to cut off funding for the troops and then open up themselves up to the traditional charge of being "weak on defense."

Concerning the impeachment of the AG...it is the only way to go. Another option is to cut funding to the DOJ completely until he resigns. I am amazed by all the Republicans here who support TSP with the arguement if you don't have anything to hide you have nothing to fear. Using that logic...what does Bush have to fear concerning having Rove and Meirs testify before the House and Senate Judiciary Committees? Executive privilege is used to hide a cover-up...whether it was to get Joe McCarthy or to block an investigation of a third rate breakin. Why Bush continues down this path is beyond me...especially by using executive privilege in the death of Pat Tillman...I want to know what national security concerns a release of those documents would entail.

In neither party is there any focus on real events affecting real Americans; disappearing middle class, outsourced jobs, millions of illegal immigrants, borders wide open, complete control of the consumer goods supply base by China, wars for oil and the entire gamut of corporate malfeasance and profit for misery that surrounds every thing.
In both parties the underlying thread is the same, globalization, and more war for profit.
Gonzalez is the face of them all, no truth, obfuscation, chicanery, nefarious dealings, lying and just about anything else you can think to conjure up.
The mentality of the world elite is to waste the lives of good people to serve their own ends, only the tip of the iceberg was seen when the firing and hiring of operatives was based upon their political or profitable leanings.
Bush nor any of his minions value the USA or its republican structure, they have created a de facto dictatorship under the noses of the population through executive order and by exempting themselves from the rule of law under the catch all of "executive privilege".
I do not think there is anyone in Congress with the guts to take the impeachment of Bush et al to its conclusion. If such were to happen, the status quo would hardly be improved by having Cheney as president, I'm getting nauseous just pondering the ghastliness of that scenario.

The last four years seem like such a prime-time soap opera, ala "Dallas". I can't believe I live in an era where the A.G. is being considered for impeachment. I can't believe the highest level of our government is still trying to lie to us about terrorists and Iraq; leading us into war with Iran. It is so insane all that surrounds our government at the federal level it is almost not believable. The shock and awe of it all leaves me so angry I can't really react anymore. I'm getting imune to it all. How can congress say they are too busy to handle these proceedings? They are not doing much about Iraq so I would think they have the time. When we all dig a little deeper we will see the Dems and Repubs are really the same problem. They are all in bed with the military complex propping up the economy in a military Keynsian fashion.
As for me, I'm looking to the new American dream as my light at the end of the tunnel. I'm setting up shop in Mexico. The political mischeif there really is a soap opera. That I can trust at least.

On the one hand, he's obviously lying, because he contradicts his own testimony. He's obviously doing it intentionally, because he keeps issuing statements two days later to "correct the testimony", and keep himself out of jail. The Attorney General blatantly and transparently lying to congress for all the world to hear damages the Justice System. Once he does that, it doesn't matter whether there was a "crime" or not. Lying to Congress is a crime. Now, quite a few people are trying to parse it out, and say legally this or legally that might happen, or say Bush is the Decider, and nothing will happen anyway, or any number of other angles. None of this matters. He lied. Repeatedly. He's a liar. He's a liar and we trust him to protect us from criminals. If one of my staff gave me answers like the ones he gave Congress this week, I'd fire them. He acted like he could just say whatever the heck he wanted to Congress, and they just had to deal with it. That's contempt.
I am amused that there are still a few Republicans out there who, when it becomes threatening to Bush, suddenly everything is all complicated. It's not complicated, it's simple. In the public sector, if he made his company look that bad, he'd be canned in a heartbeat.

Tahut, the definition I posted above explains the process. It was not intended to state whether or not he could or could not be impeached. It just defines the process. If you spent the time to read the whole post you would have realized the futility in attempting to oust AG at this time. The chances of the senate being able to muster enough votes to actually bring him to trial and be be able to remove him from office (keep in mind that impeachment only means to bring charges against him) is slim to none at this point in time. I just feel their time and effort is better spent on other matters. The Bush administration will be out of office soon enough.

George Bush has taken advantage of Senate recesses 170 times (167 times through January, 2007, and three more in April, 2007) over the last six-and-a half years to fill positions that would otherwise require Senate confirmation with people who would likely -- or certainly -- have failed to win Senate confirmation.

Bush has never missed an opportunity to flip the bird at the Senate, even permanently appointing a US Attorney using the notorious Patriot Act II provisions on the very day he signed into law Congress' legislation outlawing the practice.

The Senate is scheduled to go into recess on August 6. This gives Bush the singular opportunity to give the Senate and the people of the United States the biggest "Screw You" of his Presidency -- and to bring to a close any discussion of impeaching Alberto Gonzales -- by replacing Gonzalez (who will suddenly decide about August 10th that he needs desperately to spend more time with his family) with somebody even worse.

OK, Florida Independent -- I took the time to read your Wikipedia entry about impeachment (nice source, by the way -- I'd recommend getting your information from somewhere a bit more reliable in future), and I still don't see anything there that says impeachment proceedings against this lying sleazebag "will never go anywhere".

The only thing I can imagine makes you think that, is that impeachment is complicated and will take time. Guess what? It's supposed to be. It's supposed to be difficult to trigger an upheaval in the US political system, just as it's supposed to be difficult for a US president to impose his will on the other two branches of government -- it's part of the treasured system of checks and balances that the current administration has been chipping away at since Bush came into office, while the rest of the nation was thinking about beer, football, scary foreigners and Lindsay Lohan's boobs (though not necessarily in that order).

They are all, republican and democrat alike, too busy covering their collective backsides. They are willing enough to go for the sound byte, but not follow through. Hey, buddy... read up on your recent history. Clinton fired his AGs after his was elected the first time, NOT going into his second term after the AGs would not prosecute Democrats when they had no case. Using the Justice Department for political purposes, particularly a party's purpose is suspect and puts a dark shadow over our justice system.

Firing the AGs wasn't as much of a problem as the REASON for firing them. Subsequently, the lies the Gonzo told that were countered by people in the same room with him during these meetings.

I am truly amazed how uneducated so many conservatives are these days.

You have to love the conservative right. Their current line is if you can't show me the evidence of wrong doing Gonzales did no wrong. Now where is the evidence - well it is being withheld by the White House and by Gonzales - therefore they are de facto innocent of all wrong doing.

So by stonewalling on providing the documents and access to people who could demonstrate that the significant suspicion of wrong doing actually occurred they build their mantra that no wrongdoing occurred.

I seem to remember these same conservatives being very dedicated to the principle that the White House had to allow any of its staff to testify about anything, and had to turn over all documents requested regardless if they were tied to any wrong doing or not, or held by the president or not etc, when they were trying to find something, anything to use to discredit Clinton.

Where are these unprincipled hypocrites today. They should be screaming for the White House to allow legitimate oversite as per the constitution.

After reading "Florida Independent" and the information provided about impeachment, I say go ahead and impeach until you can't impeach anymore.

The spectacle will be breathtaking, riveting the populace to C-Span where Presidential candidates from both parties will vie for face time.

Charlie Schumer will be positively glowing with himself while Patrick Leahy, Ted Kennedy, Harry Reid et al. will be patting themselves on the back for their wild success in surpassing the impeachment fervor of the Republicans of the late 90's, achieving multiple impeach-gasms.

Nancy Pelosi will claim another half-victory for passing something that goes nowhere in the Senate because 66 votes ain't going to happen. Maybe even a few clear-headed Democrat senators will aid in putting things to a stop, as did some Republicans in the Clinton impeachment.

All the while, no one will find Osama Bin Laden, unless he complies with a Democrat summons and agrees to testify.

The people need this and they need it now, but based on these posts, no one's going to be able to make up their mind who to impeach first. Perhaps a poll of what Repug is hated the most would be helpful. There might even be some who haven't been mentioned here yet.

Let it happen because there are so many people out there who haven't reached their full frenzy potential yet and a frenzied mind is a terrible thing to waste.

Yes, impeachment is the best idea Democrats have had yet. It's not original, but I'm sure they'll improve on it.

is a slam dunk on many statutes including 18 USC 155 Fee Fixing?

Directly connected to this case you have the following issues

The US Trustee warned attorneys in the eToys matters not to
do statutory violations.
The attorneys not only disregarded the warning but admitted
to drafting a HIRING LETTER that was not revealed until
after the proof of "non disclosure" of "conflicts of interest"
occurred.

Under Penalty of Perjury that what is stated here is true and

The Director in Washington D C of the Dept of Justice
replaced the Region 3 Trustee on Dec 22 2004,
The Asst US Trustee did place a Motion to Disgorge
for $1.6 million in the eToys case 01-706.
Just 10 days later the US Attorney for the US Trustee
Office sought to Settle that Disgorge Motion.
The Settlement violates the LAW.
We complained to the Asst US Trustee and the Director
in Washington DC of the EOUST.

Both resigned after the Stipulation to Settle was placed
into the record.

The following facts below are verified by Court docket records.

We have proof the Dept of Justice management has lost its sense of honor and duty.

In the Bankruptcy case of eToys 01-706 (DE 2001) we proved over 100 felony violations by the firm of Traub Bonacquist & Fox and Morris Nichols Arsht & Tunnel.

The US Trustee is charged by the Janet Reno Reform Act of 1994 to be the "policing" "watchdog" of public entity bankrupt estates to protect equity holders.

The LAW of 18 USC 3057(a) and 28 USC 586(a)(3)(F) mandates that the US Trustee officially report all malfeasance by any attorney in a bankruptcy case to the US Attorney office for prosecution.

When we placed proofs of the "non disclosure" of "conflict of interest" into the record the Director of the EOUST in Washington D C then replaced the Region 3 Trustee on Dec 22 2004 (you can go to the US Trustee website and see the press release)

Then on Feb 15 2005 the Asst US Trustee placed a Disgorge Motion against Traub Bonacquist (TBF) into the record for $1.6 million.
(docket item 2195)

The Asst US Trustee stated that he had [fore]warned the parties not to replace any key personnel of the debtor with anyone connected to the retained professionals of the estate(which are thereby Officers of the Court).
(please see Disgorge Motion parts 19 and parts 35)

Despite that warning the parties of TBF as creditor's counsel and debtor's counsel Morris Nichols Arsht & Tunnel (MNAT) did collaboratively draft a HIRING LETTER for Barry Gold.
(Traub has admitted to paying Barry Gold 4 separate payments of $30,000 each, both pre and post petition)
(please see March 1, 2005 Transcript docket items 2228)

The HIRING LETTER was never revealed until after the deceptions of non disclosure of conflict of interest were proven.

The HIRING LETTER was used by TBF and MNAT to place Barry Gold in as the "wind-down coordinator" of eToys.

The HIRING LETTER also contained and illegal clause that brazanly REwarded Barry Gold for not seeking the Court's approval of his hiring by then giving him the CEO and Presidents Job.

When Traub stopped paying the $30,000 per month, TBF and MNAT had designed that the ESTATE pay Barry Gold $40,000 per month.

All this is admitted and in the record.

The Asst US Trustee also stated that the acts of non disclosure were deliberate, rather than inadvertent, that it was by vastly experienced bankruptcy counsels, that it destroyed the line between Creditor v Debtor, that repetitive affirmative misrepresentation of Rule 2014(Perjury) acts had occurred. That "this is all that is necessary to prove Fraud upon the Court"

Now the Asst US Trustee sought silently to be lenient by not seeking the mandatory disqualification that is required by Code 327(a) as established by the 3rd Circuit and the Supreme Ct (In re Middleton Arms)

Then less than 10 days later, the US Attorney for the new Region 3 Trustee placed a Stipulation
to Settle for only $750,000 into the record.

The Stipulation to Settle also contains ILLEGAL clauses such as

WHEREAS the United States Trustee shall NOT seek to compel TBF to make any additional disclosures.

One of the Additional disclosures the AUSA seeks to help hide is the fact that Barry Gold, MNAT and TBF all have "undisclosed" connections to KB Toys and their owner(s).

As eToys sold the bulk of their assets to KB Toys and their owners such is NOT a "bona fide" sale and is rescindable.

It is also Collusion to Defraud an Estate.

We complained to the Director of the EOUST, the Asst US Trustee and the head of President Bush's Corporate Fraud Task Force.

All 3 parties have resigned.

We also contacted the SEC Bankruptcy Fraud Div in Atlanta GA where we were told they would send the AUSA for Region 3 an Official Intergovernmental Letter for Official Investigation.

The US Attorney for the Region 3 Trustee told the SEC not to send the Letter.

Other OBSTRUCTIONS by the US Attorney for Region 3 also included aggressive acts to strike and expunge all the proofs we place into the record.

Stating that Article III does not apply to bankruptcy proceedings and that we must have their permission to point out fraud to the court.

We also contacted the FBI, the Public Integrity Section of the DOJ, the US Marshalls, the OGE, the OPR, the ORO, the OIG and more.

All referred us to the US Dept of Justice EOUST General Counsel's office.

The problems is, after the Asst US Trustee and the Director of the EOUST resigned.

She is in charge of investigating her own case.

They CAN impeach an AG--and any other officer of government. The Constitution says so and so does precedent, e.g., Secretary of War Belknap in 1876, and Supreme Court Justice Samuel Chase ca 1802. The penalty is removal from office--and all future offices of trust or profit under the United States. No torture, no execution, just getting rid of them--for good (no resurrections like Abrams and Negroponte). We do not yet know what will happen to someone who is successfully impeached and still won't leave office. I suppose this is where the military's oath to the Constitution might come in.

How anyone can feel secure when the most powerful magistrates in our government are habitually breaking the law and lying about it is beyond me. It feels very soviet to me, but maybe it's just Texas.
