Well... I suppose that makes sense in a very tangential way. The difference, of course, is that the Pats are a football organization (as apposed to a Federal agnecy) and the Jets weren't having their personal phone calls tapped (as apposed to Americans under surveilance by the illegal wiretapping). One is a scandal in a relatively meaningless (I love my team, but come on... if football ceased to exist tomorrow it wouldn't really be the end of the world) professional sport. The other is a vioation of US law by our own government.

But the idea that a game has stiffer consequences for breaking the rules than our government is a good commentary on how far the Republican culture of corruption has degraded our society.

High crimes and misdemeanors is a phrase from the United States Constitution, Article II, Section 4: "The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors."

"High" in the legal parlance of the 18th century means "against the State". A high crime is one which seeks the overthrow of the country, which gives aid or comfort to its enemies, or which injures the country to the profit of an individual or group. In democracies and similar societies it also includes crimes which attempt to alter the outcome of elections.

The first impeachment conviction by the U.S. Senate was in 1804 of District Judge John Pickering for the high crime and misdemeanor of chronic intoxication. Federal judges have been impeached and removed from office for tax evasion, conspiracy to solicit a bribe, and making false statements to a grand jury.

In the impeachment of Bill Clinton in the late 1990s for perjury, the exact meaning of the term high crimes and misdemeanors became the subject of debate. A particular subject of debate is exactly what rises to the level of high crimes and misdemeanors. Some felt that the act of perjury, a federal crime, rose to that level. Others felt that this particular act of perjury, while illegal, did not reach that level because the lie was specifically in regards to a matter of personal infidelity and that the questioning that led to it was allegedly politically-motivated. Those in favor of impeachment often counter that the conditions that led to the crime are irrelevant and that one of the President's duties is to set a good moral example, while supporters of President Clinton often contend that impeachments resulting from politically-motivated inquiries could lead to a slippery slope affecting the balance of power between the Executive and Legislative branches.

It is evident that in the absence of a clear legal definition, determining what rises to "high crimes and misdemeanors" is an inherently political process, which means that it is up to Congress and what it thinks constitutes an impeachable offense.

Just because everyone else does it don't mean that it's ok... unless it's going over the speed limit. What a bunch of self righteous hypocrites. It's a game, and everybody cheats in sports; that's why they have "officials" in zebra suits to throw a “flag on the play”. Penalties are cheats. John Madden says coaches have always stolen signals. Perhaps we need instant replay and a booth official to correct the situation in Washington too. If they could do that and overrule the call to go to war, then make the NFL commissioner our President. As for the actual incident in New England, fining the team and coach would have been adequate (since everybody else does it). Losing a first round pick was excessive and unfair to the rest of the team and players who BTW, had no knowledge of what the coaches were doing. Players/troops are clueless and too busy wiping the snot off their faces after getting smash-mouthed during the game/war to pay attention to the strategy games the coaches/politicians play. So Richardson’s analogy should have been: fine the coaches, Bush-Cheney/ Kraft- Belichick, and support the troops/players with reinforcements/1st round draft picks.

The fact that the patriots were penalized for spying just furthers my opinions that america is a pit of biased individuals that look for the next person to pick. So they spied, so what! If we start persecuting those who for one thing and not others for the same, we should start doing it to all those that violate. This includes those parents that spy on their children. Now this may not hold the same merit as the issue at hand, but it supports the fact that Bush doesnt have the right to spy on the ciizens who put him in office and those who didnt. Where is the trust, i can tell you where it is not within the hands of those who twist the rules for their on benefit.

Compare the situations: NFL - noticed the violation and dealt swiftly with it. US Government - noticed the (many) violations and complained. Violators not only unpunished but continuiing along their merry path.

I even posted to another blog that evidently this football team had misunderstood "The Patriot Act"...then, again, maybe they didn't.

1- He is a disgruntled Republican.
2- He Loves his country, but not necessarily her, or anyone else's, nasty spying habits.
