I have grave doubts about Mukasey's ability to exercise independent judgment. When his name was first put forth as the AG nominee, I poke around a little bit and what I saw made me a little nervous. However, I was willing to give him the benefit of the doubt through his hearings. What struck me was the difference between his first appearance and his second, as if he had been scolded for the independent streak he demonstrated on day 1 of the hearings.

I realize that the AG is an appointed position, and that such positions are typically filled by those who share similar philosophies as the president. However, when it comes to the DoJ, it must be allowed to place the law above the president's agenda. If the law conflicts with presidential policy, presidential policy must yield. Gonzales did not understand this, and it appears that Mukasey does not understand this either. The president is not above the law, and he above all else should be committed to following not just the letter but the spirit of the laws of this nation. We have a president who clearly will push the limits, as far as they can be pushed, in an effort to maximize his authority. In such a situation, we need an AG who is prepared to push back and to say "No you cannot do this." Mukasey is not that man, and for that reason alone, he cannot be allowed to fill the position of AG.

I'm glad that Dodd got the ball rolling by stating his opposition, and equally glad that Obama has joined him. I imagine more and more Democrats will come on board, and Republicans who want to keep their seats in 08 will as well. The American public may not understand the specifics of what happened with Gonzales but I think (or I hope) that the American people understand that Bush needs to be constrained from within his Administration as well as from without.

In the 1920's the Justice Deparment was called the department of ill repute, it is worse today. We must all be careful that the AG is not a personal mouthpiece for the executive branch. Republicans may like things this way now, but remember that a democrat in the white house will have all that power also one day, what will you say then when the party in power starts to use that power that your man gave to the office? We have checks and balances for a reason, our fore fathers saw the danger of an imperial president and took precautions, we need to keep those precautions in place.

People are also confusing the FISA act with the constitution. I may be wrong, but I don't think the FISA act (as out dated as it was) was constitutional to start with.

What took so long?

The Democratic Party presidential candidates should have announced their opposition to Mukasey just a few days following his conformation hearing before the Senate Judiciary Committee.

Poor Judge Mukasey was likely waterboarded, probably by Cheney himself, after day one of his testimony before Judiciary. By not able to provide a simple answer to a simple question about what consitutes torture (and whether waterboarding falls within that definition), tells the world be is able to serve as Attorney General.

We don't need a gray haired Gonzales wannabee as AG unable to stand up to the Bush/Cheney neocon idiots!
